08.01.2022 This photo contains sample documents indicative of the conveyancing process in Victoria. It is by no means exhaustive, but is representative of the types of documents Conveyancers are required to prepare and/or scrutinize during any conveyancing transaction. Many of these documents are presented at settlement and are closely examined by lenders and other parties alike. Consistency of information is the vital key to a successful settlement, from the initial Contract of Sale ...through to the final Notice of Acquisition/Disposition. Certificates of Title have undergone a few major changes in recent years. Due to the implementation of the new National Electronic Conveyancing system, there are now two types of Certificates of Title issued by the Registrar of Titles. The current computer generated paper Certificate of Title (pCT) which most of us would be familiar with replaced the older parchment type of Certificate of Title some time ago. Other than a few high tech security features to combat fraud, the computer folio has not changed dramatically. The second version is the electronic Certificate of Title (eCT) where ownership and other records are made electronically and stored securely within the systems of Land Victoria. This new type of Certificate of Title was adapted to accommodate the electronic settlement platform known as PEXA Property Exchange Australia, and the subsequent registration of documents at Land Victoria following a PEXA settlement. The eCT will also serve to eliminate safe custody issues with paper Certificates of Title which are often lost, misplaced or accidentally destroyed, and more importantly, it will also eliminate the burden of significant legal costs and fees associated with an application for a replacement paper title.

04.01.2022 For the state of Victoria, the recent budget increases the surcharge rates of duty and land tax for foreign purchasers. The surcharge rates for stamp duty will increase from 3% to 7% , effective from 1 July 2016 and from 0.5% to 1.5 % for land tax, effective from 1 January 2017. In essence this results in an overall increase of duty and taxes for foreign residents purchasing land or holding land in Victoria. Similar surcharges have also been introduced for both NSW and Queensland. It will be interesting to see whether or not this increase in surcharges will deter foreign purchasers from investing in our State, and what impact the potential deterrence will have on the property market.
