17.01.2022 Check out today's courier mail for more details of the continuing court battle against Octoclay Pty Ltd, a company controlled by Wayne Dwyer and formerly trading as Dwyer Quality Homes. Our client successfully obtained judgment against the company in August this year to the tune of approximately $500,000, for the costs of rectifying her leaking roof, defectively constructed by the former Dwyer Quality Homes company. However, to date our client has not received a cent of t...hat judgment and is applying for the former Dwyer Quality Homes company to be liquidated. Mr Dwyer has told the courier mail that Octoclay has no money and hasn't traded in years and therefore he won't be fighting the liquidation. Meanwhile, Dwyer Quality Homes continues to trade through a separate company created in May 2018 (after our client's legal proceedings were filed). Mr Dwyer's 22 year old son (described on LinkedIn as the company's IT Support) has been appointed as the company's sole director. QBCC records show that this company has completed $5,221,944 this financial year alone. Mr Dwyer is the same man involved in the legal battle with council regarding the constructions of their roof-top tennis court on top of their Minyama mansion. The District Court recently dismissed the Dwyer's appeal of the Sunshine Coast Council's decision to refuse their development application for approval of the roof top tennis court.

11.01.2022 ? The short answer is no but like all legal issues, there are exceptions to consider. Simply giving an honest, factual opinion won’t put you in hot water, however, making untrue, derogatory statements under the guise of an opinion almost certainly will. ... Section 31 of the Defamation Act 2005 (Qld) provides that honest opinion is a defence to defamation if the person who made the comment can prove that: (a) The comment was an expression of opinion rather than a statement of fact; and (b) The opinion related to a matter of public interest; and (c) The opinion is based on proper material. Let’s consider some examples: Comment One: ‘I recently had my car serviced by Bob the Mechanic and in my opinion, his customer service falls short of the mark, so I won’t be using his services again’. Comment Two: ‘I recently had my car serviced by Bob the Mechanic and in my opinion, he’s the worst mechanic in town, which isn’t surprising, because I don’t think he’s even qualified, and I think he takes joy-rides in customers’ vehicles’. In the first example, the customer is expressing an opinion based on personal experience. Whether the opinion relates to a matter of public interest will be a point for consideration, but typically, online reviews will satisfy that test. Finally, the opinion meets the proper material test, because it’s an opinion based on the customer’s personal experience with Bob the mechanic. In the second example, the customer claims to be expressing an opinion, but in reality, it amounts to a statement of fact. The opinion also isn’t based on proper material because the customer has no evidence to support the view that Bob isn’t qualified, or that he takes joy rides in customers’ cars. Simply using the words in my opinion won’t save the customer from a defamation action brought by Bob. Whilst the second comment is a clear example of a defamatory statement that’s intended to bring Bob’s reputation into disrepute, defamatory statements can be much more subtle.
