17.01.2022 BAINBRIDGE LEGAL CHRISTMAS GIFT APPEAL The Kmart Wishing Appeal is Australias largest and longest running Christmas gift appeal. 17.01.2022 WIFE RETAINS 100% OF THE ASSETS... We recently acted for the wife in the Family Court, and then again in the husbands appeal to the Full Court of the Family Court of Australia in the case of Adair & Adair [2019] FamCAFC 70. At first instance, the Family Court awarded the wife 100% of the net property pool in a case that involved a failure of disclosure on the part of the Husband, an alleged trust, as well as a Kennon argument by the wife (asserting that her contributions we...re made more arduous as a result of family violence). The Full Court of the Family Court, dismissed the Husbands appeal, confirming the adjustment of 100% of the property pool to the Wife, on the basis that the primary judge was not in error finding that the husband has undisclosed assets. The case also provides useful commentary in relation to Kennon arguments, and approved of the Courts reliance on findings in past parenting proceedings where no objection was raised to same during the property trial. The appeal was wholly unsuccessful and costs were ultimately awarded to our client. This case stands as a warning to anyone who thinks a failure to disclose, or non-compliance with Orders will get you ahead in the family law courts think again. 13.01.2022 The Family Law Courts have received a welcome injection of funding in the most recent federal budget. The Government announced an $80 million funding boost to frontline family law and family violence services. This includes: - $12.7 million to establish Parenting Management Hearings; - $10.7 million for additional family consultants to deal with family law cases; - $3.4 million for additional domestic violence units; and... - $55.7 million boost to Community Legal Centres and Aboriginal and Torres Strait Islander Legal Services (announced on 24 April 2017). 05.01.2022 Update - Family Court System and Covid-19 The Covid-19 pandemic has had a significant impact on Australia and the world. The Family Court of Australia and Federal Circuit Court of Australia continue to be operational. However, they have had to make changes to their operations. For example, technology is being utilised to enable the court to continue via phone and video appearances. As a result of the pandemic and the operational changes the court has had to make, we anticipate that a significant backlog in the courts ability to deal with matters quickly will arise.
