In particular our conveyancing transactions are able to proceed mostly as normal. We are able to do this by using a conveyancing platform, PEXA, which facilitates online settlements. BOT has been subscribers to the electronic conveyancing platform PEXA for some time now and our clients have enjoyed the benefits of speedy deposits of funds upon their sa...les and town agent free purchase settlements. This means we can handle conveyances for clients and properties located anywhere in Queensland. We prepare the documents electronically and settlement funds are uploaded and disbursed to the nominated payees at the allocated time and date. The platform is regulated by the Registrar in each state and avoids the need for traditional face to face settlements, an important consideration in these safety conscious times. All parties to a conveyance need to subscribe for the transaction to be completed on line and a small fee is payable to the host company PEXA. 09.01.2022 If you have an existing court application, then the Family Court and Federal Circuit Court (which handles most of our work) have said that they will be adjourning all non-urgent matters (usually property settlement proceedings) until later in the year. There will be no physical court circuits to either Bundaberg or Hervey Bay in the foreseeable future. The virus threat will necessarily channel parties’ energies towards settlement rather than litigation. The Judges have said ...that they expect to see the parties and their lawyers taking advantage of alternative dispute resolution procedures primarily settlement conferences between the parties and their lawyers and if necessary, mediation. Here at Baker O’Brien Toll, we have the technology and experience to organise settlement conferences and mediation by telephone or live stream. We have access to a range of experienced mediators who remain ready, willing and able to mediate disputes. Mediation in particular has enjoyed very high success rates. Now is the time, more than ever, to take advantage of this process and resolve your dispute in a timely and cost-effective manner. 04.01.2022 The last three or four months have been tough for everyone, including the Judges. The Covid-19 pandemic meant that the Family Law Courts moved from appearances in person to telephone and online. Microsoft Teams was rolled out during the crisis to allow Judges to conduct some final hearings online. For the most part, things have worked well, but I get the impression that the Courts would still very much like to return to personal appearances as quickly as possible. It’s stil...l wait and see for our local family law circuits in Bundy and Hervey Bay, but it is possible that personal appearances before the Court will return as early as the August sittings in Hervey Bay. During the crisis, the Judges have had to prioritise urgent parenting cases over property settlements, with many property cases adjourned off. The Judges have made it clear that they expect Family lawyers and their clients to fully utilise the alternative dispute resolution procedures available, such as mediation and arbitration. See more
