07.01.2022 Mental health is a complex area of the law. Over half of the population of Australia has experienced some mental health condition during their life, and at least 15% of criminals have a diagnosed mental illness. So how do the law and mental health interact? The Mental (Forensic Provisions) Act 1990 (NSW) provides for a range of mental health defences available to criminal defendants.... Section 32 applications are used for a wide range of criminal offences, for example assault or dangerous driving. If successful, resulting in dismissal. Instead, the defendant will be discharged with conditions to continue treatment with a psychologist. A McNaughton Defence is used for more serious criminal offences, for example murder. It requires proof on the balance of probabilities that: At the time of the offence, the defendant was suffering from a mental illness; and The mental illness caused the defendant to not know the nature and quality of their actions or understand the wrongness of them. If successful, a defendant may be released with or without conditions, or placed in a mental health facility. The Mental Health Review Tribunal will review the person every 6 months to determine whether it is safe to release them. Sane automatism can be proved where a person shows that their actions were involuntary due to an external factor, for example a psychological blow which is unlikely to recur. Insane automatism can be proved where a person shows their actions were involuntary due to a mental illness which is likely to recur. 02.01.2022 With the new year upon us, many law students are looking to apply for internships and graduate positions at law firms. So, we want to give a quick run-down of things that may assist you in your applications. 1. Make sure your resume is up to date and not plagiarised. 2. Ensure your resume is succinct and contains relevant information. There are opposing views on including extracurricular activities. What we can agree on is that your year 10 volunteer experience isn’t ...really going to help now. 3. Make sure you spell check everything, including both your resume and application email. We sometimes receive applications that are really poorly written. This doesn’t reflect well with your potential new team. 4. Look into the organisation you're applying for. What does the firm do? Is it criminal, family, commercial? 5. In your application email, address the relevant person at the firm. "To whomever it may concern" doesn't look professional. Worse still, Hi I am looking at obtaining a role with your firm. If the relevant person isn’t known, call the firm and ask them who to send it to. We prefer that you’re not shy. Otherwise, at the bare minimum, address the firm or organisation as a whole. For example, "Dear Banga Legal". 6. If you wish to ask questions in the application email, ensure they are relevant to the organisation. Time the questions right as some are best asked in person. 7. Clean your social media! A number of firms and organisations will browse your social media to find out the type of person you are. Its best not to have your dirty laundry available. We hope this helps!
