JobKeeper does not give employees the right to refuse to work. The JobKeeper scheme and the coronavirus pandemic has not changed the fundamental feature of employment that employees must do as their employer reasonably and lawfully requires.... If the work is reasonable and lawful, the employee has an obligation to do it, and, should they refuse, the employer has the right to consider commencement of disciplinary action against the employee.

There are currently no special leave provisions within the Fair Work Act - the Fair Work Ombudsmans website states that full-time and part-time permanent workers who cant come to work because they are sick with COVID-19 can take paid sick leave, or if they need to look after a sick family member or housemate they can take paid carers leave. They can also take unpaid carers leave if they run out of paid sick or carers leave.

12.01.2022 ? Work health and safety laws apply to all businesses if workers are required to work somewhere other than their usual workplace, for example, working from home. In this instance employers must ensure, so far as is reasonably practicable, the health and safety of their workers.... Risks that an employer should consider include: workstation set up work hours and breaks physical environment: heat, cold, lighting, electrical safety, home hygiene and home renovations psychosocial risks: isolation, reduced social support from managers and colleagues, fatigue, online harassment, domestic violence. At the very least, employers should consider having employees complete a Working from Home Safety and Wellbeing checklist.
