20.01.2022 QLD Govt Announcement: Changes to Queensland land tax Changes to the Land Tax Act 2010 were announced in the 2019-20 Queensland Budget. The changes relate to absentees, companies and trusts, and will take effect on 30 June 2019. Absentees... Australian citizens and holders of an Australian permanent visa will no longer be subject to the rates and surcharge applicable to absentee land owners. Foreign individuals will be subject to an increased absentee surcharge of 2%. Companies and trusts For companies or trusts with aggregated landholdings above $5 million, the land tax rate will increase by 0.25 percentage points. Foreign companies and trustees of foreign trusts will be subject to a 2% surcharge. 11.01.2022 BUYING A PROPERTY IN QLD: Ok, you've signed the contract, but who is responsible to insure the property? The short answer to who is responsible to insure the property is contained in the contract of sale. The current standard residential contract of sale (the REIQ contract in Queensland) provides that the property is at the Buyer’s risk from the first business day after the date of the contract. This means that if the property is damaged (in most cases) the Buyer still needs... to complete the contract to purchase the property. The result is that unless you have insurance in place, it can happen that you are left to buy a property which is worth much less than it was when you signed the contract. The next question is "WHY"? Why do you as the Buyer have to carry the risk? The Buyer does not have the benefit of the use of the property, and is not in control of the property to mitigate the risk for its damage or destruction. Why should they carry the risk, and have to insure the property that they will only get on Settlement? There is no good reason, but if you sign the standard REIQ contract, that is the terms of the contract to which you are bound, and you will need to take out insurance the day after your offer is accepted. There is a simple solution however: Standard conditions can be changed depending on what the parties to the contract agree to at the time of entering into the contract. You just need to ask the Estate Agent to change the standard clause of the contract regarding risk to the effect that the property remains at the risk of the seller up until settlement. If this is the case, you would not be required to take out insurance for the property until settlement. The Seller will probably have insurance in place, and in most cases, will not baulk at having to keep their property insured until Settlement.
