24.01.2022 Did you know...On 9 May 2017, the Government announced proposed changes to the Foreign Resident Capital Gains Withholding (FRCGW) rate and threshold? These new changes will apply to contracts entered into on or after 1 July 2017. What are the upcoming changes?... From July 1, the FRCGW withholding tax rate increases to 12.5% from 10%. This applies to properties where the purchase price is $750,000 and above, where it previously applied to properties over the purchase price of $2 million. The existing threshold and rate will apply for any contracts that are entered into before 1 July 2017, even if they are not due to settle until after 1 July 2017. What you need to do to avoid the 12.5% tax: Australian residents can avoid the 12.5% withholding tax rate by providing one of the following: When buying property over $750,000, you will need to obtain a Clearance Certificate from the Australian Taxation Office (ATO) and provide this to the purchaser prior to settlement, For other asset types, a vendor declaration is required to prove you are not a foreign resident.

In other words, if you are either (i) Australian citizen; (ii) Australian permanent visa holder; or (iii) a special category visa holder you are not foreign. 05.01.2022 Foreign resident capital gains withholding payments - impacts on foreign and Australian residents On 9 May 2017, the Government announced proposed changes to the foreign resident capital gains withholding (FRCGW) rate and threshold. Background Broadly, where a foreign resident disposes of certain taxable Australian property, the purchaser is required to withhold an amount from the purchase price (see note below) and pay that amount to the Australian Taxation Office (ATO). Note: the legislation specifies that the withholding is actually on the "first element of the cost base". However, as purchase price is understood by vendors and purchasers, and in many instances will equate with the "first element of the cost base", we have used the term purchase price for simplicity.
