14.01.2022 {New Article} Attending Paramedic’s Judgment Call Not Negligent In this case, that went through several appeals leading to a High Court decision, a claim was made against the Queensland Ambulance Service (QAS) over the failure of one of its #paramedics to promptly administer adrenaline to a patient suffering a severe asthma attack. The paramedic in question had promptly administered salbutamol rather than adrenaline due to the risk of causing heart failure as the patient alre...ady had a very high heart rate. However, it was alleged that, if the adrenaline had been administered, the patient would not have suffered their subsequent hypoxic injury that resulted in severe, irreversible brain damage. One of the central arguments advanced was that the paramedic had failed to follow the QAS Clinical Practice Manual (CPM) as it was asserted that the CPM positively prescribed the administration of adrenaline in these circumstances. 05.01.2022 A recent decision out of the Supreme Court in Cairns resulted in a victory for an injured #cyclist who took evasive action to avoid a reversing driver. The plaintiff was riding his electric bicycle along McIlwraith Street, South Townsville, where the roadway is fairly wide with spaces for perpendicular parking outside the store. As they were approaching their destination, the vehicle driven by the defendant reversed into his path. The cyclist was #injured in attempting to tak...e evasive action. Although #liability was admitted, there was a claim on behalf of the defendant's insurer that the plaintiff had been contributorily negligent for not keeping an adequate lookout, for travelling at an excessive speed to negotiate around reversing vehicles and for failing to ride in the middle of the lane where he would have been more visible to reversing drivers.
