07.01.2022 Media companies Facebook pages: An important precedent In an important recent case, the Court of Appeal DISMISSED an appeal which sought to challenge a finding that operators of Facebook pages may be publishers of defamatory comments made by Facebook users on news items posted on those pages. In December 2016-February 2017, Fairfax and other media outlets posted news items concerning the incarceration of Dylan Voller in a juvenile justice detention centre in the Northern ...Territory. Third parties posted comments critical of Mr Voller, who commenced defamation proceedings against the applicants claiming that particular comments posted by third parties conveyed imputations that were defamatory of him. The trial judge found that the media companies could be held liable as publishers of those comments, and the Court of Appeal has upheld this decision. The Courts reasons include that each of the media companies accepted responsibility for the use of their Facebook pages for the publication of comments, including defamatory comments, and that they actively invited the making of those comments. 04.01.2022 ANIC commences defamation action against Moustafa Rashed Birchgrove Legals defamation team was recently briefed by the Australian National Imams Council (ANIC), who held grave concerns over several targeted and highly inaccurate internet publications. ANIC has launched legal action against Mr Rashed asserting that Mr Rashed made a number of false and potentially defamatory imputations about the organisation and its constituent members.
