25.01.2022 Meet the Biztech team! Anthony Bekker founded Biztech Lawyers in 2018 after his experience working at Mallesons Stephen Jaques across ecommerce, technology, finance and litigation, followed by in-house stints at global behemoth (BT) and for the UK competition and consumer regulator (the OFT). An MBA at INSEAD led to a change in direction spending time at a top global strategy consulting business, and projects in the Netherlands, Singapore and the US. Then joining marketing technology business Rokt as inaugural General Counsel and Head of Operations, building both divisions from the ground up.

25.01.2022 Since Australia is lagging NZ in this COVID-19 debacle - here's a useful bit of information from NZ. NZ moved to L3 lockdown yesterday. NZ moving to full L4 lockdown TOMORROW. ... For a sense of what that means: People instructed to stay at home Educational facilities closed Businesses closed except for essential services (e.g. supermarkets, pharmacies, clinics) and lifeline utilities Rationing of supplies and requisitioning of facilities Travel severely limited Major reprioritisation of healthcare services You can checkout the NZ Govt Beehive press release here: https://hubs.ly/H0nPrQX0

23.01.2022 A strange thing happens when you're forced to spend a lot of time at home. You start seeing the things that are broken around the house. There is a new urgency to fixing them. For tidying up. For getting rid of excess and simplifying your life. Funnily enough it seems as though the same thing is happening to a lot of tech startups and scale-up companies right now....... https://hubs.ly/H0pyLcH0

17.01.2022 In case you missed it amongst the chaos of late - a really interesting survey of Australian Startup salaries for #Founders #Product #Engineers #Sales #Operations #Data #Finance #HR #Customer Support #Design #Marketing. While the data looks a little thin in places to give reliable stats (even though they took data on over 1000 remuneration packages from 63 venture capital-backed companies) it is a useful and rare source of #benchmarking. Most interesting are the CEO dilut...ion metrics which show CEOs own on average 44% of equity where < $500k raised, 47% between $500K and $1M raised, 26% between $1M and $3M, 23% between $3M and $5M, 25% $5M to $10M; and 6% from $10M+ raised. Of 21 reported COO/Head of Ops/Strategy mean salary was $148,250 with 42% having ESOP, while of 19 CFO/VP/Head of Finance mean salary was $166,370, 52% having ESOP. Broader access to ESOP plans looks low, and patchy with only 40% of Sales, 38% of Eng hires reportedly having 'access'. It seems like a remarkably low number given the general availability of tax-efficient ESOPs nowadays. We'd be keen to know what you take from it?!? 13.01.2022 We've been reflecting on the somewhat dire circumstances our clients (friends) around the world, and in Australia, find themselves in right now. It's often hard to think of anything good that can come of it. Pictures of lame Australians fighting over toilet paper are deflating (not to mention needless - haven't they heard of paperbark trees?). Particularly compared to the inspiring images of Italians singing with abandon into their alleyways, Spaniards doing workouts on ...their balcony and Chinese back to work. So where to find good news? Well some may take solace in the idea from very bad circumstances, including pandemic flu from 130 years ago, can come very good law. So from the famous 'Carbolic Smokeball' case we learn that every contract requires offer, acceptance, consideration and an intention to create legal relations. The case also kicked off the consumer protection movement. The other good news is the plaintiff in that case, Mr Carlill, went on to live to 96 years old. The moral? Don't give up, and call your lawyer if you need help. And it left us wondering But we're left wondering if anyone is researching carbolic smokeball's effectiveness on COVID 19? Stay safe everyone! https://hubs.ly/H0nF2pq0
13.01.2022 NSW pushes for stronger federal data bill to protect privacy "The federal government is proposing a more subjective, principles-based test that requires agencies to be satisfied sharing is reasonably necessary to inform or enable better policy, research and service delivery. To be satisfied, agencies must determine the sharing meets a UK-based test known as the five safes. This has been incorporated into data-sharing principles developed by the Australian Bureau of Statist...ics and the Data Commissioner's office. However, the NSW chief data scientist, Dr Ian Oppermann, strongly supported by the NSW Minister for Customer Service, Victor Dominello, has been pressing federal officials to embrace a broader and more objective test. This test addresses the risks associated with the misuse of the data deliberate or unintended and considers the context of the release. In total the test covers 10 safes, including the life-cycle of the data use, and the response if things go wrong." https://hubs.ly/H0m_kwy0
13.01.2022 An interesting development - CSIRO says laws should be 'published in code'. This makes complete sense for certain types of rules and assisting in the application of laws by government bureaucrats - eligibility for benefits, approving licences and so on. It would seem less appropriate where exceptions and ambiguities in legislation abound - sometimes deliberately so, for political expediency purposes. Watch this space! https://hubs.ly/H0mCXy60

12.01.2022 'Fringerprinting' is a term that means the various techniques that try to examine what makes a given users browser unique, and in doing so fully or partially identify individual users or devices (even when cookies are turned off). This could include using tiny bits of information that vary between users (such as what device they have or what fonts they have installed) to generate a unique identifier which can then be used to match a user across websites. 11.01.2022 Media interviews will play a vital role in your business’s portrayal to the public - how you or your colleagues come across in an interview will determine how you are perceived by the public. Partaking in media interviews will help build the profile of a business and its products and services, which will help you gain potential customers, employees, investors and build a strong reputation. Particularly as a tech startup you will want to portray your business in a positive li...ght. While interviews may be challenging, it can be an opportunity to grow the profile of the business, therefore it is important that you come across well in any media interviews you are a part of. 07.01.2022 A new cautionary tale from Wired on ransomware 'for hire'. While we've not been privy to the terms of service - apparently would-be hackers can buy the ransomware with a money-back guarantee! "Attackers started out by researching potential targets with valuable data and the means to make big payouts when faced with the dim prospect of losing access to it. The attackers then used a list of words in hopes of gaining access to one of the accounts. Eventually, they hit the jackp...ot: an administrative account that had free rein over the entire network. The weak account password, combined with the lack of multifactor authentication protection, gave the attackers all the system rights they needed." ... In a testament to their confidence and determination, the LockBit sellers have forked out almost $75,000." https://hubs.ly/H0q62JT0

04.01.2022 This article, and the research paper it discusses, are fascinating not only because of its findings, but because of the amazing insights that can be drawn from #bigdata from 40 million Uber trips: "Combining experimental and natural variation in the data, we are able to establish tipping facts as well as provide insights into the underlying motives for tipping. Interestingly, even though tips are made privately, and without external social benefits or pressure, more than 15% of trips are tipped. Yet, nearly 60% of people never tip, and only 1% of people always tip. 02.01.2022 Let’s face it: no startup founder wants a legal dispute hindering the growth of a new company. But the reality is these disputes come up more often, and in more forms, than you might think. If a conflict does arise between businesses who have a contract for goods or services, the contract will usually specify how disputes are to be resolved.... Litigation, or going to court, is probably the most recognisable avenue for disputing parties. But going to court is often a time consuming, expensive and highly formal enterprise. Thankfully there are alternative forms of dispute resolution available to help the disputing parties come to a resolution. One common type of alternative dispute resolution (ADR) is arbitration.
