21.01.2022 Cheaper and Affordable Justice in Civil Law Disputes should be closer with the Local Court Small Claims Division to Increase to Jurisdictional Limit from $10,000 to $20,000 when sitting in its Small Claims Division.The Small Claim Division Caps legal fees and will the new increase in the jurisdictional limit, more claimants will be afforded the protection of the capped fees.

21.01.2022 Just a reminder. An amendment to the Conveyancing (Sale of Land) Regulation 2010 will require the vendor under a contract for the sale of land to provide a current Land Tax Clearance Certificate (section 47 certificate) to the purchaser. All contracts entered into on or after the 1 July 2016 will require the vendor to provide the purchaser with a current certificate. Vendor information required (where applicable) when completing the application for a Land Tax Clearance Certificate is listed in the Commonwealth Reporting Reference Table.

14.01.2022 The Office of State Revenue NSW will be required to collect and report transfers of freehold or leasehold interests in real property situated in New South Wales to the Commissioner of Taxation from 1 July 2016.They will obtain this information by requiring Vendors to provide the purchaser with a clear Land Tax Certificate on all contracts for the sale of land. Apparently, the reason is to obtain information for the purpose of the new National Register of Foreign Ownership of Land Titles.

14.01.2022 National Cabinet Statement Commercial and residential tenancies 29 March 2020 We will keep you updated with anything further from the State and Federal Governments... "As part of its work on helping businesses hibernate, National Cabinet agreed that short-term intervention is needed for commercial tenancies. Work on this has begun, but there is more to do, including for residential tenancies. National Cabinet agreed to a moratorium on evictions over the next six months for commercial and residential tenancies in financial distress who are unable to meet their commitments due to the impact of coronavirus. Commercial tenants, landlords and financial institutions are encouraged to sit down together to find a way through to ensure that businesses can survive and be there on the other side. As part of this, National Cabinet agreed to a common set of principles, endorsed by Treasurers, to underpin and govern intervention to aid commercial tenancies as follows: a short term, temporary moratorium on eviction for non-payment of rent to be applied across commercial tenancies impacted by severe rental distress due to coronavirus; tenants and landlords are encouraged to agree on rent relief or temporary amendments to the lease; the reduction or waiver of rental payment for a defined period for impacted tenants; the ability for tenants to terminate leases and/or seek mediation or conciliation on the grounds of financial distress; commercial property owners should ensure that any benefits received in respect of their properties should also benefit their tenants in proportion to the economic impact caused by coronavirus; landlords and tenants not significantly affected by coronavirus are expected to honour their lease and rental agreements; and cost-sharing or deferral of losses between landlords and tenants, with Commonwealth, state and territory governments, local government and financial institutions to consider mechanisms to provide assistance. National Cabinet will meet again on Monday 30th March 2020."

09.01.2022 A million dollars for big ideas to boost access to justice Published date: Thursday, 20 December 2018 People with new and tech-savvy solutions to improve access to justice will have the opportunity to have their ideas funded through a new grants program established by the NSW Liberals & Nationals Government. ... Attorney General Mark Speakman said the $1 million Access to Justice Innovation Fund is designed to encourage inventive ideas to increase access to justice for those who need it most. Up to $250,000 will be available each year for four years from the beginning of 2019. Every year, nearly three million people in NSW experience a legal problem, 85 per cent of which are civil law issues. These can range from neighbourhood disagreements over trees or fences to contract disputes involving many millions of dollars, Mr Speakman said. Grants will be open to applicants such as legal professionals, community groups, coders and social entrepreneurs who have ideas for projects to improve the way legal problems are resolved, or to help people more easily navigate the justice system. The fund is part of the Governments Civil Justice Action Plan which has already delivered new guidelines to reduce local councils reliance on court action to recover unpaid rates. Such actions presently make up 30 per cent of Local Court civil matters. From early March 2019 individuals and small business in particular will benefit from being able to pursue and defend monetary claims of up to $20,000 in the Local Court, providing a quicker, less expensive means of resolving disputes. The current maximum claimable amount in the Local Court is $10,000. The Civil Justice Action Plan reinforces the Governments commitment to improving access to civil justice, particularly for the vulnerable and disadvantaged, Mr Speakman said. The fund will focus on projects that demonstrate how technology or new methods of service delivery can support small business and people who are experiencing social and economic disadvantage to resolve legal problems. For example having prominent signs stating requirements, Service NSW QR codes, staff checking vaccination status upon entry and only accepting valid forms of evidence of vaccination, or medical exemption. What proof of vaccination can I accept from my staff and cu...stomers? Only the following three forms of evidence of vaccination (or medical exemption) should be accepted: 1.A COVID-19 digital certificate displayed through the Medicare App, Service NSW App or equivalent smartphone wallet Penalties may also apply for anyone making or presenting a fake form of proof of vaccination. Authorised officers will monitor businesses re-opening, particularly those that have vaccination requirements, for example hospitality, retail, gyms and personal services (e.g. hair, beauty). Additional documents are to be attached to contracts being: An additional sewer diagram is required where necessary to show the location of sewer lines.... All strata by-laws in force for the scheme to be included in the contract. A new warning statement must be included in the Contract which alerts potential purchasers to the possible presence of Loose Fill Asbestos; See the Conveyancing (Sale of Land) Regulation 2017.
