It sends a very troubling message that if an officer acts unlawfully then it's highly likely no action will be taken because the watchdog can only watch so many, RLC police powers solicitor, Sam Lee said.

Our client was facing a trial by jury in the District Court on 14 charges including sexual intercourse without consent, sexual touching and choking. At all times our client maintained his innocence. If found guilty he faced the prospect of a lengthy jail term. One of the key issues in the case was the admissibility of DNA evidence served last week by ...the Crown. Blaxland Criminal Law sought advice from its own DNA expert and submitted that the evidence should be excluded. On Friday of last week all charges were withdrawn and dismissed. Telephoning our client and his family to deliver this news was a rewarding moment for our team. 20.01.2022 All Charges Dismissed Today Blaxland Criminal Law appeared at Burwood Local Court for a client charged with four counts of breaching an AVO. Police alleged our client telephoned the protected person whilst in custody, from phone accounts registered to him, that the calls were recorded and that he identified himself to the victim on the phone calls. Notwithstanding what appeared to be a very strong case against our client, following argument as to the deficiencies in the inves...tigation and the Police’s failure to strictly adhere to certain procedural matters, all charges were dismissed. It was a great result which demonstrates the importance of engaging a lawyer who has expertise in the procedural requirements Police must follow. 10.01.2022 ALL CHARGES WITHDRAWN AND DISMISSED Blaxland Criminal Law received this lovely token of appreciation following the withdrawal of all charges in a long running criminal matter. Our client was due to stand trial at the end of August on three serious charges: ... 1 - Aggravated enter dwelling and commit serious indictable offence; 2 - Assault occasioning actual bodily harm; and 3 - Stalk and intimidate. The Crown relied heavily on DNA at the scene to establish our client’s presence and his role in the incident which involved various knives. Blaxland Criminal Law engaged its own DNA expert and served a report which provided an alternative explanation for the DNA consistent with our client’s innocence. On the Thursday before the trial, Blaxland Criminal Law were notified that the DPP were withdrawing all charges. A fantastic result. This is the second case since trials resumed in 2020 where we have successfully had charges withdrawn following the engagement of our own DNA expert. Our client was clearly thrilled with the result. He told us that he was initially advised to plead guilty ‘because your DNA is all over the place’. It again demonstrates the importance of engaging solicitors who understand the use and limitations of DNA in criminal proceedings. 09.01.2022 Blaxland Criminal Law's client avoids jail for crime spree from Queensland to New South Wales On Thursday of last week Blaxland Criminal Law appeared at Port Macquarie Local Court. Our client was being sentenced for five offences including assault with intent to take motor vehicle, obstruct officer in execution of duty, fraud offences and being carried in stolen conveyance. The charges resulted from a series of attempted car jackings and break and enters from the Queenslan...d boarder to Newcastle over a 48 hour period in April 2019. Blaxland Criminal Law presented detailed submissions which evidenced exceptionally compelling subjective circumstances. Our client was afforded leniency by the Magistrate avoiding a custodial sentence and receiving a Community Corrections Order for two years and two further orders for twelve months. Our client's co accused received a non parole period of three years and six months with a head sentence of five years. 07.01.2022 On Monday Blaxland Criminal Law’s client was acquitted of reckless wounding in company. She walked freely from the Downing Centre District Court after months in custody. Our client was charged as part of an extended joint criminal enterprise. Following extensive oral and written submissions in the District Court, the Judge was satisfied that our client could not have reasonably foreseen the circumstances of the incidental offence. Another great result for our team.

07.01.2022 Blaxland Criminal Law achieved another great result today. Our client was charged with supplying GHB and possession of methyl-amphetamine. He was detected by NSW Police during a search of his belongings on Oxford Street and following an examination of his mobile phone. Our client admitted to selling drugs to fund his own habit. Today he received a conditional release order without conviction for each offence. BCL prepared detailed written submissions setting out the relevant... considerations, including our client's serious health issues. We ensured our client obtained excellent references and prepared a statement of remorse to the Court. After consideration of our material and taking into account our client's prior good character, the Court saw fit to release him without conviction on two conditional release orders. Another illustration today of how important expert legal representation is in effectively conveying subjective circumstances to the court. 07.01.2022 https://www.dailytelegraph.com.au//54a6b89c7858108b2f807f6 A terrific result for Blaxland Criminal Law's client after his charges were all dismissed at Waverly Local Court. The Magistrate accepted that Mr Mellor was truthful in his description of the events to NSW Police. His Honour fully rejected Ms Pike’s version of the incident. In relation to Ms Pike’s evidence his Honour stated:... [she]realises today the severity of what she’s gotten herself into. It is my view as much as she’s tried to unravel it, it has not worked so today she’s very defensive. I do accept the accused’s version. I reject the version in terms of the complainant in this matter. Following Mr Mellor’s acquittal, the NSW Police applied for an Apprehended Domestic Violence Order. His Honour refused that application stating: I rejected her (Jade Pike’s) evidence. On 21 June she was unravelling. She was the person who was depressed. She couldn’t accept the breakup, lost control on this date she was pushing, she was slapping. I don’t find that there is a basis, even on balance, that there was a trigger for the apprehended domestic violence order. Mr Mellor is now considering commencing civil action against the NSW Police.

06.01.2022 Another happy client. A terrific result today. Charges were negotiated and downgraded in the Local Court. Client and family thrilled with the outcome on sentence. 'Judge Colefax dismissed the crown prosecutor's submission that Birchell should be sent to jail, instead placing him on a two year community corrections order, triggering tears from Birchell's mother inside the courtroom. "It was a momentary lapse in judgement," he said. "In addition to your work (in the boxing industry) you have been an outstanding member of your community. You have engaged at an impressive level with young people...particularly young aboriginal males."
