22.01.2022 Changes to the Australian Citizenship!!! - The Immigration Minister Dutton has formally introduced the Australian Citizenship Legislation Amendment (Strengtheni...ng the Requirements for Australian Citizenship and Other Measures) Bill 2017 to the parliament today. The key changes which will effect applications lodged on or after 20 April 2017 are the requirement of 4 years permanent residency visa instead of current one year, as well as the introduction of the competent English requirement, where the Bill vested the power with the Minister to determine what is competent English. The Minister stated that in his speech applicant will be required to undertake a separate up-front English language test with an accredited provide and achieve a level of competent. (though the Minister did not define the meaning competent English, but according to the Migration Regulations it is understand of achieving IELTS 6 each or equivalent test). There will be exemptions granted to applicants over the age of 60 or under 16, or citizens from the listed English speaking countries Canada, UK, USA, New Zealand etc, exemptions may also give to applicants who undertake specified English studies at a recognised Australian Education Institution. Further important changes post commencement of the legislation is the eligibility of Australian citizenship for children born in Australia and resided in Australia for 10 years. The draft legislation will only allow children to apply who stayed legally in Australia within the 10 years period and have a visa to return to Australia at all times if they travelled outside of Australia unless they are stateless. It also banning a child from obtaining citizenship if one of the childs parents was illegal in Australia when the child is born. This can prevent unlawful non-citizen from obtaining residence by given birth to a child in Australia and remain for 10 years. The good character requirements will apply to all ages rather than applicants over the age of 18. The Bill also prevent applicants with pending criminal offence or convicted of serious criminal offence or confined to psychiatric institution due to a criminal offence from granting citizenship within a specified period of time. General residence requirement wavier of an Australia citizens partner do require the Australian partner to be present in Australia for at least 365 days during the 4 years residence period. Wider Citizenship Cancellation power available where fraud and misrepresentation were involved by any person and does not have to have constituted an offence, but only if committed within 10 years before the application. The Minister also seek absolute power to override the Administrator Review Tribunals decisions with respect to the Citizenship Act. Currently once the AAT may substitute a decision made by the Ministers delegate (the Department of Immigration) it will become binding on the department, the Minister has no power to intervene. Though under the draft legislation applicants can apply to Court for review but it would be a lot more difficult especially if it is in relation to the merits of the case. We do note that this is a Draft Legislation pending the Australian parliament. They will only come into effect after the approval from the Australian government.
