16.01.2022 The Facts of De Facto. Be prepared for what may ensue: "Tara wasn't married, but it still cost $20k to leave her relationship."
13.01.2022 Executive Officer of the NSW Rape Crisis and Domestic Violence centre, Karen Willis, has explained how their phone lines go ballistic the day school returns. Call centre attendants are scheduled to do extra shifts to respond to the increased volume of calls.
10.01.2022 In the Spirit of National International Woman's Day, our Principal, Alan Blumberg, spoke to a group of women from the Mum for Mum Program about Family Violence, AVO's & the role of the Court. Some of the key takeaways were: 1. If you find yourself in an abusive relationship, inform your doctor, social worker, friends, keep abusive SMS’s and recordings as these can be used as evidence. ... 2. AVO's or restraining orders should be sought if a partner is violent or abusive and can be beneficial later down the line. 3. Seek professional support if you are in a violent or abusive relationship. Call 1800 RESPECT. 4. Get sound legal advice early if you experience any abuse. Abuse can include financial abuse and social control. 5. The rights of the child are always the most important. A child is best off with the input from both parents unless the child is at risk. Just because a dad doesn't pay child support does not mean he is a bad dad. 6. It is very difficult to access legal aid unless you have very little income and assets. The court system is struggling under a very heavy load with limited resources as a result the process can be very slow and judgements that are critical can take years before they are produced. Thank you to Mum for Mum for all the great work they do in assisting Mums, building up the confidence of Mums and keeping them safe. Alan Blumberg has significant experience within the field of Family Law and enjoys being a sounding board to Mum for Mum.
06.01.2022 Earlier this week Chief Justice John Pascoe told the National Family Law Conference 2018, just how increasingly complex family law had become. It was noted by the Chief Justice that a royal commission into family law should be considered if the amendments presently underway failed to address the complexities the current system has been criticised for. It was said by Chief Justice Pascoe that the constant tampering with the current system, which has run for well over 40 years,... adds to the "complexity, uncertainty and cost & often we don't tackle the really big issues - such as the divide between child protection and the family law system." In closing, and we couldn't agree more with the following statement: "Whatever happens, the focus has to be on the best interests of children, including their safety, and the welfare of families."

04.01.2022 Excellent piece by our Colleagues at Wolters Kluwer, summarizing the talk delivered by Diahann Gordon Harrison, Children’s Advocate of Jamaica, at the National Family Law Conference, 2018. Diahann spoke on how parental rights exist in so far as these rights are in accord with rights of the child. "Parents have a joint and primary responsibility for securing the best interests of their child which must be achieved within the confines of the rights of the child. If parents are... not able to do this, the state must step in to secure the child’s rights and needs."
