25.01.2022 STATISTICS | Asian Australians are underrepresented in the legal field, according to Australian race discrimination commissioner Chin Tan. Asian-Australians account foronly 3.1 percent of partners in law firms, 1.6 percent of barristers and 0.8 percent of the judiciary, said Mr. Tan in 2019. He said that lawyers from an Asian background were not able to break through career barriers, which is termed as a bamboo ceiling. ... Such underrepresentation impacts not only on the individual but also in areas like justice, where it has a systematic impact.

23.01.2022 ANNOUNCEMENT | Each week, the ALSS is hoping to post some interesting facts about Asian representation in the Australian legal profession as well as interesting facts about laws and legal policy decisions in other Asian jurisdictions. We hope that these posts will not only broaden your understanding of the relationship between Australia and Asia but also inspire you to look beyond the Australian borders for career paths. William Ah Ket was the first Australian barrister of A...sian heritage. Ah Ket fought against legislative amendments to the 1907 Factories (Employment of Chinese) Act which sought to discriminate against Chinese residents working in the furniture industry. He also challenged the Immigration Restriction Act better known as the White Australia policy. Throughout his +30-year career, Ah Ket was never promoted to the rank of senior barrister or appointed a judge. Nevertheless, his legacy has made a profound impact on both the legal profession and Australia as a whole. In 2019, the William Ah Ket Scholarship was established by the Asian Australian Lawyers Association and Maddocks. Read more: https://asialink.unimelb.edu.au//celebrating-asian-austral

18.01.2022 Kingdom of Thailand’s Lèse Majesté Law Under Article 112 of Thailand’s Criminal Code, anyone convicted of breaking the Lèse Majesté Law can face up to 15 years prison. In Thailand, monarchs are protected by the Lèse Majesté Law which allows critics of the monarchy to be jailed for 3-15 years. Recently, King Vajiralongkorn asked Prime Minister Prayut Chan-o-cha to not prosecute individuals under the Lèse Majesté Law. However, the PM warned critics to remain cautious as ‘it could have severe consequences on their future and job opportunities.’ Legal analysts also stated that the Lèse Majesté Law is also present in Thailand’s Computer Crime Act which ‘serves a similar function by targeting those who make critical posts of the monarchy online.’ http://www.thailawforum.com//thai-pm-says-the-king-instruc

14.01.2022 ‘Bilingual lawyers have a competitive edge’ The globalisation of Australian law firms has increased demand for lawyers with foreign language skills but multilingual lawyers are in short supply, one recruiter says. In today’s job market possessing sufficient bilingual skills will give graduates an advantage when presenting to potential employers. Especially for those interested in work abroad.... According to the 2011 Census, only around 23.2 percent of Australians speak any language other than English at home. Less than two percent speak Mandarin. Former federal minister Andrew Thomson stated, Foreign language skills can certainly be helpful especially if a firm's business and client base extend outside of the country in which they are located. https://www.lawyersweekly.com.au//16804-bilingual-lawyers-

01.01.2022 REFORM | While cryptocurrencies and virtual assets are near impossible to counterfeit, ‘cryptocurrencies are not issued by any central authority, rendering them theoretically immune to government interference’ (Frankenfield, 2020). In 2019, the Financial Action Task Force called for G20 nations to establish legislation to assist the fight against proliferation of illicit activities through virtual transactions. South Korea’s National Assembly addressed this by introducing n...ew amendments to the Act on Reporting & Use of Specific Financial Information in March 2020. Key features of the act: 1. Defines a virtual asset/ virtual asset business under Korean Law; 2. Regulatory oversight by the Korea Financial Intelligence Unit including powers to refuse/cancel business filing, suspension of assets in circumstances of gross negligence/money laundering/terrorism financing, and powers to file criminal charges); and 3. Burden on financial companies/other entities to report certain details of all cryptocurrency customer transactions. See: https://www.thekoreanlawblog.com//korean-cryptocurrency-la
