14.01.2022 Mediating at 20 paces...A la Belle France Commencing in a few hours, the International Chamber of Commerce, located in Avenue President Wilson, Paris, France, will hosts its 11th International Commercial Mediation Competition. Along with my esteemed mediation and facilitation colleague, Anne Sutherland-Kelly, I have been asked to co-coach the very capable Monash University JD Program Team comprising Eleanor Downie, Stephanie McCulloch, Natalie Rae and David Tai.... The contest looks huge. Approximately 80 Universities from over 40 countries are participating. They include the very well-known names like Oxford, Georgetown, Fordham, Cornell - the ADR (Alternative Dispute Resolution) specialists, Pepperdine, Startup Nation - Israel’s Bar-Ilan as well as Universities from Kosovo, Japan, China and our team Monash University, The contesting teams are judged by mediators who hail from all corners of the globe. A one day conference for all the contributing parties to hear some new thought in the field of ADR was held yesterday before the competition event commences. Four interesting case studies (drawn from actual cases) have been written up as the issues. The contestants will mediate/negotiate these four problems over the preliminary rounds. Each University receives a role to play in each of the 4 issues, as the requesting party or the responding party. Our team was drawn from a group of JD students who sought to represent Monash U. Professor Tania Sourdin and Naomi Burstyner also of Monash University coordinated and delivered the unit, along with Anne. I was a coach to the teams in the lead up to their selection. Over the summer, the team has been preparing, practicing and perfecting their approach in attempting to negotiate best outcomes with role-playing opponents. The coaches have been working alongside the team answering all their questions, such as: How do I determine how much information to disclose and when? What would make this discussion less formal and more constructive? Will this approach uncover their underlying interests? When can I start proposing options for solution? All are valid questions that many business people face on a daily basis. Until the competition starts, time is needed to acclimatise. A search for a good café in Mabillon, a chicken soup in the Marais, a fine warm dish around le Senat and maybe even some Jazz in St Germain would help. Ahhh, La Guerre! If you do get together and an issue arises, try to look for those underlying issues, rather than fall into a default and tried (yet failed) approach of battling one another.
