23.01.2022 Victoria's rolling lockdowns of the economy have not only created an economic disaster, health issues that could have been prevented but will kill, suicides and mental health problems but legal vacuums. Commercial landlords and tenants in Victoria are in no man legal land. The previous legislative framework, seriously lacking in certainty and clarity, was a framework of sorts. The legal battles will continue for years. Now there is nothing. If you are an existing tenant your ...only option is to negotiate with your landlord but - for how long. There is no certainty, no clarity - nothing. In law, where there is no certainty the clause or the agreement is struck out. For tenants and landlords this is the reality. If you are a landlord negotiating a new lease the unknowns are like a chasm. What period and what percentage do you negotiate, is it a week by week affair in line with the lack of thinking of the Victorian government and how can week to week survive in a commercial reality? If you are a landlord negotiating a new lease where do you even start. There is no history of performance by the incoming tenant. Even is the incoming tenant has a history of performance in another location or a different business model how do you negotiate terms and conditions. These are the gaping legislative and commercial holes that no-one has addressed nor will they. The vast majority of landlords are 'mum and dad, family operations' and the vast majority of tenants are 'mum and dad, family operations'. They are all economic victims of the lockdowns and the drip down effect is enormous. A tenant cannot pay rent if they cannot operate, a landlord cannot collect if the tenant has nothing. These are the realities that my clients have been facing for well over a year and they have only become worst. The collateral damage of the fight against a virus, an impossible one, is far greater and its duration will be here for generations. See more

14.01.2022 Crypto currency is a whole new world and a whole new product when it comes to assets. It is also a complex and difficult asset to trace. This has been highlighted for Boon Legal recently when acting for a deceased estate. Unlike shares, money invested with financial institutions and real estate, there are no public records to search, no institutions to ask and no public footprint. The various currencies, amounts invested, sold, are all totally controlled by the individual and... the various mechanisms the individual creates using their mobile, computer, laptop. I am sure that people are familiar with the story about the person who lost millions because all the information was stored on a hard drive they threw out. The same would be the reality for a person where a USB stick or a personal computer or mobile phone are thrown out, damaged, destroyed or go missing. If a person has crypto currency, to protect their investment while they are alive and for the sake of those who benefit from their estate after death clear records need to be kept and shared with a person or persons that are trusted. The money that has been lost and will be lost in crypto currencies is in my view staggering. See more

12.01.2022 Changes in lending to overseas purchasers caught most developers unaware, significantly impacting on their profitability and for some spelling disaster. Most developers have relied heavily on sales to byers from mainland China. Most of these purchasers funded such acquisitions through loans from Australian financial institutions. However, when that option was switched off these purchasers found themselves unable to finalise the purchase. They could no longer borrow from Austr...alian financial institutions and strict laws about the amount of money that any individual can transfer from China meant that developers were left with a high number of properties that could not settle. This was a potential financial disaster. At Boon Legal we worked with our developer clients to come up with solutions and were able to come up with solutions that worked for our clients and the purchasers. We are happy to say that our developer clients avoided potential disasters and have finalised their developments with a healthy profit and not a financial disaster. We have had many years of experience working with developers, from a three town house development to staged, mixed use developments of over 300 lots. We understand the challenges and realities that developers face and work with our clients to ensure the best outcome.

12.01.2022 Know your rights Everyone is a lawyer. In contrast, not everyone is a brain surgeon or a hairdresser or an accountant or a nurse or a paramedic or a tiler. I have seen a lot of cases where people relied on bush lawyers with dire consequences. Below is an example where bush lawyers advised on a deceased estate. ... A mother left her real estate and all her money to her two sons. She left some furniture to the daughter. The daughter asked her bush lawyer friends for advice and they told her that because the mother had left her something she could not make any further claims. The daughter relied on her bush lawyer friends and did not make a claim. The two brothers applied for and were granted probate. They gave their sister the furniture which she failed to collect as the cost of transport was higher than the value of the furniture. They sold the property and deposited the proceeds into a term deposit, along with the mother’s savings. Six months after the grant of probate they distribute the estate to themselves, in accordance with the mother’s will. The brothers had solicitors and were rightly advised not to distribute for a period of six months after the grant of probate in case there was a claim against the estate. If the claim was successful they would be personally liable if the estate had been distributed. Three months after the estate was distributed the daughter sought legal advice. Based on her financial dependency on the mother, her poor health, no real estate, no savings and the fact that she was on a Disability Pension she would have been entitled to a portion of her mother’s estate. In contrast to her, the brothers owned real estate, had savings, superannuation and above average incomes. However, by the time she gave up on her bush lawyer friends and sought legal advice she was out of time to make a Part IV application. Even that was not the real deal breaker. The real deal breaker was that the estate had been distributed. This is an example where the reliance on bush lawyers had dire consequences for the client. The only way to protect your rights is to get legal advice from lawyers who have relevant experience as soon as possible.

10.01.2022 Divorce, divorce, divorce! Most people whose marriages have come to an end settle financial and child matters, either by consent or by court orders. However, many of them do not take the step of applying for a divorce. Some people believe that property or child consent orders finalise everything. Others simply do not turn their mind to it as they have no plans to remarry. What most people do not know is that as long as you are legally married, regardless of how many years y...ou have been separated, under Victorian law if you die your husband or wife has a right to your estate and your superannuation. I have dealt with many such cases. In one case a 35 year old woman died accidently. She had been separated from her husband for over 5 years. They had even had a property settlement between them. They had absolutely no contact during that 5 years. He found out that she was deceased through mutual friends. She died without a will and he immediately made an application to administer her estate. I represented the deceased's mother who had provided her with emotional and financial support. In the settlement between my client and the estranged husband my client got the majority of the estate and the husband got the rest. At the mediation his own barrister said that this was a windfall for his client simply due to the law, not anything that he deserved. Even though we had evidence that the deceased had downloaded and started completing a divorce application she had not filed it and in the circumstances her husband, a totally undeserving beneficiary, made a windfall. Even if you do not have any intention to remarry you should make sure that you divorce your husband or wife. While there is criteria as to when you can file an application for divorce it is a step that you should take. At Boon Legal we provide family law and probate services.

07.01.2022 In Victoria, until late 2018, a person did not have to provide any photo identification whatsoever when selling or purchasing a property. However, since 2018 any dealing at all with real property requires a verification of identity by way of photo identification with passports and drivers' licences being the preferred documents. Not everyone has either of these, especially older people. I have come across this problem when providing Notary Public services to people as well. Notaries Public always require verification of identity by those signing documents. For people in this situation the quickest and cheapest solution, and sometimes the only one, is to get a Proof of Age card. This is available to anyone, regardless of their age and the application is made at your local post office.

04.01.2022 I am a solicitor and Notary Public in Australia. I am also Croatian. I do a lot of documents and documentation for Croats for overseas probate matters. I often get asked to act in such matters. My advice to clients ALWAYS is - get a solicitor in Croatia. The simple reason is that if you have solicitors here in Australia they are only instructing solicitors in Croatia. This means you are doubling your costs paying for two sets of solicitors. No solicitor in Australia can de...al with matters in Croatia. There are the practical issues - someone has to prepare and file documents and appear in court. This cannot be done remotely. Secondly is the question of legal capacity. Unless a solicitor has been admitted in Croatia they do not have any legal standing to appear as solicitor in Croatian courts. As to the myth that Australian lawyers can do things quicker I do not see how having an instructing solicitor in Australia, dealing with Croatian laws, procedures and processes can achieve this. It can't. There is nothing special or superior about Australian law or lawyers in Croatia. If the matter is in Croatia get a lawyer there and don't waste your money by doubling up on fees. See more

04.01.2022 The NBN was rolled out at 414 Lonsdale Street, Melbourne last week. My office is on level 6 of the building. On Wednesday, 3 March 2021, without any notice whatsoever the NBN disconnected my internet, telephone and fax. My service provider, Telstra, has advised that once the NBN disconnects someone there is nothing they can do. I no longer had an option to have the ADSL service reinstated and had to move to the NBN. To make this happen my service provider has to contact the N...BN and both the NBN and the service provider have to make the NBN connection happen. It may well be easier to realise a united Korea. The optimistic timeline for anything to happen is 2 weeks. The NBN is uncontactable. Each and every option directs you to another authority or an internet address. They don't have to be contactable. The NBN has powers that many of the world's dictators would envy. It is also one of the most dysfunctional organisations, like an octopus whose tentacles no longer connect to a centre, each out on a frolic of its own. In a world where a business cannot operate without the internet there are still no timelines or deadlines for the NBN. The complaints procedure is lengthy and unsatisfactory. In any event, no business could survive waiting for the outcome. The record of service is truly shocking. In 2021 in the 'clever' country I have to look solutions outside the NBN and my own service provider for both my internet and phone. So much for a clever Australia. See more
