24.01.2022 Good news for Chefs, bricklayers and tilers THOUSANDS of foreign chefs, bricklayers and tilers will no longer have to be sponsored by employers to obtain permanent visas, as the Abbott government eases skilled migration rules to address alleged labour shortages. Under changes backed by business groups, the three professions have been added to the Skilled Occupation List from July, meaning these workers will be able to apply for a permanent visa without requiring a sponsor.... 24.01.2022 Other Family and Non-contributory Parent visa application to cease- In clarification to the 2014 Federal Budgets announcement of the cessation applications for Other Family and Non-Contributory Parent visas, the Department has provided the following advice: Applications can still validly be lodged. All valid applications will remain in the pipeline and be processed in due course. The cessation of new applications under the Other Family and Non-Contributory Parent visas will ...take place prior to the start of the 2014-15 programme year. The visa subclasses affected are: Parent (subclass 103) Aged Parent (subclass 804) Aged Dependent Relative (114) Remaining Relative (115) Carer (116) Remaining Relative (835) Carer (836) Aged Dependent Relative (838). Specifics concerning the date the necessary regulatory changes will take effect have not yet been settled and we will get earliest advice to you and your industry colleagues once these details become clear. The announcement in the Budget papers concerns the cessation of new applications under the Other Family and Non-Contributory Parent visa categories and didnt make reference to capping at zero or other measures, that would affect applications validly lodged prior to the cessation date. Since the date the necessary regulatory changes will take effect has not yet been decided, it would be advisable to lodge any pending application as soon as possible.

21.01.2022 Subclass 186 and 187 policy relating to start up businesses has changed from 1 July 2014. Businesses no longer have to operate for 6 months in order to nominate for 186/187 ENS/RSMS visas. Under the old policy," the nominator must demonstrate that their business has been actively operating for a period of at least 6 months before lodging a nomination. .....The entity must have operated for a full period of 6 months from the time it 'actively commenced operations to satisfy th...e requirement to be actively operating." Start-up businesses For the purposes of the regulatory criterion requiring active operation, a start-up business is one that has been in active operation for a period less than 12 months. A business would be considered to have commenced 'active operation' once the ABN and/or ACN comes into effect and the entire infrastructure necessary for the activities of the business is in place and the business has commenced providing services to customers/clients. The evidence that will be required to establish the date of commencement of active operation will be dependent on the type of business activity undertaken. For example: a person operating a restaurant would be taken to have commenced active operation on the day on which the restaurant was officially opened to the public a person providing a consultancy service would be taken to have commenced active operation on the day they were awarded their first consultancy contract. A start-up business must provide business activity statements for each complete quarter from the time of commencement of operations up until the time the nomination is lodged. The start-up business will not be determined to have been actively operating until the ABN and/or ACN of the business has been registered in addition to the business physically operating. The result of this is that, if a business has operated for a long period of time but has changed ownership or structure resulting in a new ABN and ACN being required, this business is now considered a start-up business. In addition, they may provide a combination of the following documentation, depending on the nature of the business activity: contract of sale relating to the purchase of the business (if the nominator purchased an existing business) lease agreement relating to business premises evidence of lease or purchase of machinery, equipment and furniture contracts to provide services evidence of employment of staff business bank statements covering the period of operation letter of support from the accountant to the business.

19.01.2022 Disallowance Motion - non-contributory parent and other family visas - TODAY 11.50 AM Senator Hanson-Young's disallowance motion against the Migration Amendment (Repeal of Certain Visa Classes) Regulation 2014, as contained in Select Legislative Instrument 2014 No. 65 [F2014L00622], made under the Migration Act 1958 was successful. The cessation of non-contributory parent and other family visas has been disallowed and these visas can now be lodged again.... According to Minister Cash's speech against the motion, the parent visa queue is currently 25 years long.

18.01.2022 Rumours about changes to student visas. The Migration Institute of Australia has advised that a rumour is currently circulating among the student population that individuals entering Australia on ETA visas will not be eligible to apply for student visas onshore. The Department's Student Policy section has confirmed this rumour is false and there are no plans to amend the migration legislation to make ETA visa holders ineligible to apply for a student visa in Australia.

15.01.2022 Federal Budget 2013/2014 As the budget was just released, we can expect more details of the planning for the next 12 months in the migration program will be available soon. The good news is that for the next 3 years the migration program will remain steady at the current 190,000 people per year. In theory that means criteria is unlikely to become harder given that there are not the push factors from overseas that there was 3 years ago. 14.01.2022 You now have more options for English language testing Additional English language tests have been added to the IELTS and OET and will be accepted from November 2014 for temporary graduate, skilled, work and holiday, and return resident visas classes. The new approved tests will be Test of English Language as a Foreign Language internet based test (TOEFL iBT) and the Pearson Test of English Academic. 13.01.2022 New Skills Assessment rules clarified. In response to the MIA's enquires to the Department regarding the operation of the new skills assessment validity periods and changes to skills assessing authorities, the Department has provided the following clarifications: All visa applications made on or after 1 July 2014 will be subject to the new regulatory requirements concerning the validity of skills assessments. Applicants who have been invited to apply are encouraged to apply ...on or before 30 June 2014. Validity criteria will not affect partner skill points. The relevant subclause being amended is 189.212, which will require that the primary applicant has a valid skills assessment at the time of invitation. With regard to 189.214, the points score specified in the letter of invitation must be at least the same or greater at the time of application. Where the new instrument specifies a change in skills assessing authority ie VETASSESS to ANMAC. VETASSESS assessments will continue to be valid for three years from their issue date.

12.01.2022 Strong growth in Subclass 457 visas 2012-13. The subclass 457 visa program recorded strong growth in 201213, with 68 480 subclass 457 visas granted to primary applicants in 201213, exceeding the previous record of 68 310 set the previous year. At 30 June 2013, there were 191 200 subclass 457 visa holders in Australia, of whom 56.5 per cent were primary visa holders. 11.01.2022 Major Changes to 457 and SIV announced The Government has announced important changes to the Significant Investor Visa and creation of a Premium Investor visa. The new Premium Investor Visa (PIV) will require an investment of $15 million, nomination by Austrade and has no residency requirements. PIV holders will be eligible for permanent residency after holding the complying investment for 12 months.... Other changes include: the involvement of Austrade in the nomination of applicants on behalf of the Australian Government and in determining complying investment policy allowing 'role swapping' between primary and secondary applicants during the provisional visa stage introduction of 180 day residency requirements for secondary visa holders changes to improve visa processing times The changes will be made progressively through the 2014-15 programme year, with changes requiring legislative amendment expected to come into effect from 1 July 2015. The Federal Government has also announced the following changes to the 457 programme: streamline the processing of sponsorship, nomination and visa applications to reward low risk applicants and refocus compliance and monitoring activities on high risk applicants; increase the sponsorship approval period from 12 to 18 months for start-up businesses, to give start-ups more time to make their businesses sustainable; provide greater flexibility in relation to English language testing and skill requirements for 457 applicants, to ensure that the standards required are appropriate for the industries and occupations being sought; and retain the Temporary Skilled Migration Income Threshold at $53 900, ahead of a review within the next two years. The Government's statement also said: "Safeguards will remain in place to ensure that the 457 visa programme is not rorted. It will continue to be a requirement that a foreign worker receives at least the same market rates and conditions that are paid to an Australian doing the same job in the same workplace."

02.01.2022 Australia still a popular tourist destination, over 3.1 million visitor visas granted to March 2014. Australia continues to draw high levels of interest from international visitors according to the latest departmental report http://www.immi.gov.au//visitor-visa-quarterly-report-mar1 The department has granted more than 3.1 million visitor visas this financial year to 31 March 2014, which is nearly 6 per cent higher than last year.... Interest from Asia continues to rise significantly with tourism visa applications from China up 22 per cent (to more than 380 000 applications), Malaysia up nearly 26 per cent (to more than 187 000 applications) and applications from India up 19 per cent (to more than 102 000 applications). The report also outlines some key initiatives of the Visitor visa programme including the introduction of a three-year validity, multiple entry visa for Chinese business visitors to enable them to engage in important bilateral trade and investment activities along with the opening of new Australian Visa Application Centre (AVAC) in additional countries, including India in June 2014. Also the expansion of online visitor visa applications in May 2014 means it is now possible for visitors from an additional 51 countries and regions to apply for their visitor visa online.

Article from the Australian newspaper on 11 June 2014 The Immigration Department has cast doubt on the viability of Labors overhauled business migration program, as legal experts branded the two-year-old scheme a dismal failure that prompted an enormous decline in new visas. A joint parliamentary inquiry into the Business Innovation and Investment Program has heard the program, introduced in 2012 to raise the quality of busines...s migrants, is plagued by slow processing, unpredictable outcomes and selection criteria that deter good candidates in a search for ideal, younger migrants. Only 652 visas were granted over the first 21 months of the BIIP scheme, which awards applicants points depending on characteristics such as age, English level and wealth. That compares with 6790 in the final year of the system it replaced, the Business Skills Program. The department, in its -submission to the inquiry, indicated the plunge in applicants will make it increasingly difficult to maintain the number of business migrants as a proportion of the overall permanent migration program. While there are sufficient applications under the previous business skills program to guarantee the 2013-14 program, the application rate may put the delivery of the 2014-15 program in question, the submission read. Sydney legal firm Immigration Solutions Lawyers, in its submission, blamed the enormous decline in applicants to overly onerous selection criteria that strive for an unrealistic ideal. A desirable candidate is someone between 35-39 years of age with a business turnover that is not under $1 million, with at least four years business experience and who has $1.3m in assets, it read. However, such a candidate would be unlikely to elect Australia due to heavy government regulation, taxation, and it being a relatively small market on the very outskirts of the Pacific Rim. The venture capital entrepreneur stream for migrants who have secured $1m from a local firm and have the endorsement of a state or territory government has attracted only one applicant since July 2012. That person was not successful as of March 31. Christopher Levingston, a Sydney migration solicitor, argued mainland Chinese applicants were deterred by possible information sharing between the department and communist law enforcement. Candidates correctly believe (the department) sharing information with (China) is not only a breach of privacy but also places at risk persons who might be considering migration to Australia in order to spread the risk of having to operate a business in a totalitarian regime. Brisbane lawyer Dolf Van Zyl said in a submission the current program is a dismal failure and not reaching any objects whatsoever. The BIIP program makes a negligible contribution to the generation of economic growth and drastic changes need to be made to the program.
