19.01.2022 The Retail and Other Commercial Leases (COVID-19) Regulation 2020 (NSW) has become law and has reinforced the Government's National Code of Conduct in relation ...to dealings between landlords and tenants of retail and commercial leases. The law, among other things, stops landlords from evicting impacted tenants and exercising other rights where the tenant has failed to pay rent, outgoings and/or not opened during certain hours for the next 6 months. It also forces the parties to renegotiate rent payable under the Lease however, allows landlords to defer such payment. There are guidelines regarding the amount of the reduction and how rents can be deferred.
