25.01.2022 REAL ESTATE SCAM ALERT A very cunning scam involving emails from real estate people who you know is happening. It works like this: You receive an email from a real estate person you know. Your Inbox clearly shows the name of the person so you believe it to be genuine. The body of the email is an exact copy of a real email from that person (logos, colours and all), and the signature block is that of the real estate person. The email invites you to view your latest invoice, sta...tement, or the like the same as you would normally do. But the link or attachment provided dumps malware onto your computer to send your logins and passwords to a foreign site. You don’t suspect anything because clicking the link or attachment appears not to work. And bingo, you’re another scam statistic. Of course this same scam can apply to any company or authority that you deal with. They only have to intercept a legitimate email and add their malware to it then send it on to you. Some banks and others like Qantas now have a third level of login security, texting you a code number to put in as well. This is where it also gets tricky, because if the scammers have ported your phone number across to them as well, even that provides you no security. I’ve received one of those real estate scam emails, but fortunately didn’t click the link. The message is to be aware, protect your logins, and check before you click. 11.01.2022 What does Offers Over mean in Queensland? Many Agents use Offers Over in advertising property. To buyers, it is one of those oddities that often confuses. Take for example a property advertised as Offers Over $390,000. An offer of $390,001 is an offer over the stated price.... But many sellers are looking for an offer much higher than that. And often, sellers are not properly advised as to what it means. To the Office of Fair Trading (OFT), it has a very distinct meaning. The official opinion is that by stating a price ($390,000) that is the minimum that a seller will accept. That includes $390,000 itself!! So an offer at $390,000 is quite legitimate and indeed should be accepted by the seller if there are no other offers over that price. Basically, the OFT considers the use of Offers Over for any other purpose as Bait Advertising. It also warns that bait advertising is illegal with both the seller and Agent sharing liability. The following is from the Office of Fair Trading (Qld) website. Visit that site for more information: Some private treaty sales are marketed to buyers with an ‘offers over’ price tag. If you use an ‘offers over’ price tag, it is the Office of Fair Trading’s view that it should carry the minimum amount the vendor is willing to accept to sell the property. If a property is offered for sale at a specified price, while knowing the vendor will not sell the property for that price, it is bait advertising. The vendor’s minimum selling price is the list price noted on the Property Occupations Act 2014 appointment form (Form 6). Bait advertising is an offence under the Australian Consumer Law carrying a maximum penalty of $220,000 for individuals and $1,100,000 for corporations. Bait advertising is prohibited because it gives buyers a false impression about the price a seller will accept for a property. To avoid falling into this trap, make sure your Agent is aware of this requirement.
