19.01.2022 The Fair Work Ombudsman has secured $86,000 in penalties in the Federal Circuit Court against the operators of two food outlets in northern Queensland. 18 empl...oyees, including 11 juniors aged between 15 and 18 years old, were underpaid a total of $13,913.63. In addition to the penalties, the Court has ordered the operators to back-pay the employees plus interest. Employers are on notice that they must pay all employees according to Australias lawful minimum pay rates and we will continue to take action to protect young workers. We will enforce the law in a proportionate matter during the COVID-19 pandemic but will not hesitate to take action in response to deliberate and egregious non-compliance, particularly where vulnerable workers are involved. Now that were a few months into JobKeeper, you might be looking at your... decreasing leave balance and wondering whether you can save some leave for when travel restrictions ease. The JobKeeper rules in the Fair Work Act say you can be asked to take annual leave, but you have to keep a balance of at least 2 weeks. 15.01.2022 Some changes have been made to the Australian Government Parental Leave Pay scheme. From 1 July, eligible employees can split their parental leave pay over 2 pe...riods. The first parental leave pay period is a continuous period of up to 12 weeks, accessed within 12 months of the childs birth or adoption. The new flexible period allows employees to access another 6 weeks (or 30 days) of parental leave pay flexibly over the first two years after the childs birth or adoption. 09.01.2022 If your boss is no longer participating in JobKeeper, but they’ve still had a decline in turnover, they could be regarded as a ‘legacy’ employer. Legacy employe...rs can still give you some JobKeeper directions, such as reducing your hours, as long as you were previously eligible for JobKeeper. To give these kinds of directions, they must follow other conditions too. If your boss is a legacy employer and has any existing JobKeeper directions with you, they will end on 27 September 2020. Any new JobKeeper direction made by your boss to reduce your hours of work must: leave part-time and full-time employees with at least 60% of your ordinary hours as at 1 March 2020 (although sometimes a different way of working out these hours can apply), and result in you working for 2 hours or more on a workday. 06.01.2022 Legislation has passed Parliament that extends the JobKeeper provisions in the Fair Work Act. The extended provisions take effect from 28 September 2020 and the... last day that they apply is 28 March 2021. There have been some changes made in the new provisions including allowing some employers, known as legacy employers, to continue using some of the extended JobKeeper provisions for their previously eligible employees if they meet certain conditions. The previous JobKeeper provision allowing employers to make agreements with eligible employees to take annual leave has been repealed and stops applying from 28 September 2020. Increases to awards will start on 3 different da...tes for different groups of awards. Frontline and essential services get the increase from 1 July, 2020. Manufacturing and construction award wage rates will be increased from 1 November, 2020 and accommodation, food, retail, tourism, and aviation will be increased from 1 February, 2021. For anyone not covered by an award or an agreement, the new national minimum wage (NMW) will be $753.80 per week or $19.84 per hour. The increase to the NMW applies from the first full pay period starting on or after 1 July 2020.
