25.01.2022 Yesterday, the passing of Federal Circuit Court Judge Guy Andrew was discovered. As stated by the Chief Justice of the Family Court, William Alstergren, His tragic passing is a timely reminder of the extraordinary pressure on all who practice in the often highly emotive family law jurisdiction. This pressure can be exacerbated by appointment. Tomorrow is the first day of WA Mental Health Week, which is designed to remind us of the importance of reflecting on our health and ...wellbeing, and that of our community. It has never been more important to be mindful of mental health and wellbeing for everyone, including our colleagues in the profession and our clients. There are many resources and avenues available to assist if you are struggling, please reach out for support and assistance to ensure positive mental health during the difficult and emotional times often associated with legal matters. 25.01.2022 It is a busy Friday morning at Butlers! One of our team members is on day 3 of a Trial in the Family Court, 2 of our criminal lawyers have Hearings in the Magistrates Court, and another criminal lawyer is appearing in the District Court this morning! Plus in-office appointments consistently throughout the day. We are very proud of our team for balancing an extreme workload at times, and providing the best possible service to our clients.

23.01.2022 The Family Violence Legislation Reform (COVID-19 Response) Bill 2020 has seen amendments made to The Criminal Code, Sentencing Act 1995, Sentence Administration Act 2003, Bail Act 2005 and the Restraining Orders Act 1997. The reform has made amendments to a substantial number of sections within the Acts. For those practitioners that deal with any of these Acts it is worthwhile reviewing the full list of amendments at www.parliament.wa.gov.au... Some noteworthy amendments to the Restraining Orders Act 1997, for example, include: 1. s 25(1): amended to delete the words "in person" so that an Applicant may make an Application for an Order online rather than being required to attend court in person; 2. s 61: amends to create separate offences for breach of an FVRO and a VRO and increase the penalty to $10,000 or imprisonment for 2 years, or both; and 3. s 63: amends to add sub section (3AA) to make it clear that the Family Court of Western Australia can make Restraining Orders ex parte in the course of existing proceedings under the Family Court Act 1997 and Family Law Act 1975 and that the Children's Court of Western Australia can make Restraining Orders ex parte in the course of protection proceedings under the Children and Community Services Act 2004.

14.01.2022 Unfortunately, as parents, you may face the unfortunate prospect of helping your child through a police matter if they've made a silly mistake. The implications can interfere with their choices for the rest of their lives, with career opportunities and schooling, so it is imperative that you assist them to get early advice. If your child is facing charges, contact Butlers for a free appointment now.

10.01.2022 A Big shout out to our wonderful team of caterers and suppliers who helped make our Event last night such a success. The food from Platters to Please and Frost That Cupcake was beyond mouth-watering. The mobile bar and service from Tailored Events Group were second to none, and the decorations from Inked & Etched were breathtaking. Perth really is lucky to have such wonderful businesses such as these guys. Highly recommended to anyone who wants nothing but the best.

03.01.2022 Just announced, the Morrison Government will establish a $13.5 million pilot program known as the 'Lighthouse Project'. This project is aimed at better identifying and supporting families who enter the family law system and who are at risk of domestic violence. The Family Law Amendment (Risk Screening Protections) Bill 2020 supports the establishment of the pilot program. Furthermore, a specialist family violence list will also operate in the Federal Circuit Court of Austral...ia which will enable identified families to be fast-tracked with appropriate security measures put in place.
