12.01.2022 From Pervaiz Buttar for your information with the recent #CVD19 changes to the #Workerscompensation laws. Send us a direct message if you have specific enquiries. Those in ACT should seek to have their laws brought in line, if not already so emended. Below in NSW WC Act 1987 by inclusion of s19B(9) will be presumed to have caught Covid 19 in employment and will be able to establish a WC claim:... ‘prescribed employment’ means employment in any of the following (a) the retail industry (other than businesses providing only on-line retail), (b) the health care sector, including ambulance officers and public health employees, (c) disability and aged care facilities, (d) educational institutions, including pre-schools, schools and tertiary institutions (other than establishments providing only on-line teaching services), (e) police and emergency services (including fire brigades and rural fire services), (f) refuges, halfway houses and homeless shelters, (g) passenger transport services, (h) libraries, (i) courts and tribunals, (j) correctional centres and detention centres, (k) restaurants, clubs and hotels, (l) the construction industry, (m) places of public entertainment or instruction (including cinemas, museums, galleries, cultural institutions and casinos), (n)the cleaning industry, (o) any other type of employment prescribed by the regulations for the purposes of this definition. In six European and many American jurisdictions Uber drivers have been judicially considered to be employees and workers entitled to protections and rights under their respective industrial laws. Control of Uber drivers is moved between parent and subsidiaries in several countries to ensure such arrangements may be harder to discover. Without discovering such arrangements, declared to be sham in Aslam case lost in UK in two appeals by Uber, in Australia the arrangements are declared by Cth Fair Work Ombudsman, FWC and in appeal to be koshar. Even Icare in NSW has not compelled Uber local entities to take out policy for workers compensation and Uber maintains drivers are not ‘workers’ nor (as taxi drivers are) ‘deemed worker’. Section 19B of 1987 legislated by NSW Parliament, as a consequence, protects taxi drivers from presumption of Covid as work related may not help Uber drivers who must be by amendment in the definition of ‘deemed workers’ to specifically included to remedy mischief. ‘Passenger support services’ though possibly wide enough category in s19B, excludes Uber drivers, allegedly not workers, with Covid 19 possibly covered by uninsured liability scheme albeit (unless SIRA or Icare has intervened), Uber may not have yet taken out any policy for Uber drivers.
