15.01.2022 Our tip of the day: ALWAYS check the contract! Our client engaged us to buy a villa in Canterbury featuring a great courtyard. The client’s solicitor had reviewed the contract and section 32 document. The quote was fully priced and reflected the scarcity value the front courtyard provided. We double checked the contract and found the courtyard was in fact common property and not on title! While there are strategies to obtain this land on a 99 year lease, our client was not wa...nting to deal with these matters and wanted complete flexibility to deal with the space in the way she wanted. The solicitor had done their job but did not know the client was only interested in the property for the fantastic courtyard. Once we alerted the client to the actual title and common property allocation, the client decided to pull out of the sale, it was not what they thought they were buying after all!
