25.01.2022 It is Fun Fact Friday! Are you of the belief that there is no need to get a Divorce if you have separated your assets? Read on... Whilst a property settlement severs the financial relationship between the parties, while you remain legally married there could be ramifications for your estate after your death.... A Family Provision Application is an application to the Court seeking that adequate provision be made for support from the deceased persons estate. A spouse of a deceased person is eligible to bring a Family Provision Application against an estate, which can include a husband or wife despite separation. It can also include the children of your husband and wife despite your separation. A divorce ordinarily means that your ex-husband or wife, and their children, cannot bring Family Provision Application against your estate. We recommend all separated parties consider formalising an Application for Divorce to avoid this preventable situation for their loved ones.
