12.01.2022 Why is it a problem for facilities and providers to label certain procedures as being "required"? Required - verb (used with object): To call for or exact as ob...ligatory; ordain. To place under an obligation or necessity. To ask for authoritatively or imperatively; DEMAND. Verb (used without object): To demand; impose obligation. Informed Consent: As an ethical doctrine, informed consent is a process of communication whereby a patient is enabled to make an informed and voluntary decision about accepting or declining medical care. (ACOG Committee Opinion 439) In a 2006 article titled "Clinical Ethical Decision Making: The Four Topics Approach", the authors state that in addition to confirming the patient has been given sufficient information, and is able to interpret the information, it is "equally important" to be "sure that when a patient consents to a medical treatment, the decision is made in a truly voluntary manner and not coerced". When a patient is told a procedure is "required", it gives the sense that the patient never had the right to decline the procedure, which is incorrect. Policies may require the staff to endorse the procedure, but it is not a requirement for the patient to give consent. In ACOG's Committee Opinion Number 390, titled "Ethical Decision Making in Obstetrics and Gynecology", ACOG states that "in the obstetric setting", physicians should "recognize that a competent pregnant woman is the appropriate decision maker for the fetus that she is carrying". As to the consent forms that you will likely be asked (required?) to sign, ACOG states that "often, informed consent is confused with the consent form. . . The consent form only documents the process and the patient decision. The primary purpose of the consent process is to protect patient autonomy." A consent form is not a contract. You can revoke consent at any time. Facility and provider policies are not patient requirements. You still have a right to informed decision making, which includes the right to refuse, even when the procedure is labeled as "required". I'll leave you with a final statement from ACOG: "Pregnancy is not an exception to the principle that a decisionally capable patient has the right to refuse treatment, even treatment needed to maintain life.
