Often we are called when a child has suffered an injury on holiday or a traumatic injury as their parents (though they be parents still) do not have the same rights over decisions for their 17 year old and their 18 year old. When the fires have passed and the people are mourning and we can see the devastation it may be time to sit down and talk about #climate and #weather strategies for this country. That and the incapacity of insurance companies to deal with these crises (despite collecting the premiums set by their actuaries with these events in mind). We need greater regulation for timely and professional claims handling by #insurance companies. 15.01.2022 #Rentrelief #covid #lease #sme Rent relief negotiations are a vital component of the survival strategy for many businesses experiencing significant disruption due to COVID19. The National Cabinet’s mandatory Code of Conduct for landlords and SME tenants provides guiding principles for negotiating rent relief arrangements where tenants experience financial strain due to COVID-19. However, many businesses may not survive if they cannot negotiate more favourable rent waivers tha...n the minimum proposed in the Code. The impetus for the Code is to assist SMEs to survive beyond the period of disruption. The Code diminishes the usual power imbalance in favour of landlords in rent relief negotiations, as it requires that landlords must provide relief so as to share the financial impact of COVID-19 on tenants. The Code includes the following principles: 1. Landlords must offer tenants proportionate reductions in rent payable in the form of waivers and deferrals of up to 100% of the amount ordinarily payable, based on the reduction in the tenant’s trade during the COVID-19 pandemic period and a subsequent reasonable recovery period. 2. Rental waivers must constitute no less than 50% of the total reduction in rent payable 3. Payment of rental deferrals by the tenant must be amortised over the balance of the lease term and for a period of no less than 24 months, whichever is the greater For a business that has had to cease trading due to COVID-19 and currently has no revenue, as a minimum, the landlord must waive 50% of the rent and defer payment of the other 50%, which accrues during the period of no revenue. After trading resumes, rent relief arrangements continue during the recovery period. No one can be certain of the timeframe for the COVID19 pandemic to end. When it does, disruption to business may dissipate but for some businesses there may be a long recovery period before revenue approaches pre-disruption levels.

01.01.2022 Get your house in order - remember a Will is the document that might be a last coversation with a loved one. New PD issued by the Chief Justice of the Supreme Court in relation to informal wills executed during COVID-19. In effect, if drafted by (or witnessed by, or supervised by) a solicitor, then wills that are witnessed by 1 or 2 witnesses via video conference but not physically, may be admitted to probate by the Registrar under s18 of the Succession Act 1981, rather than ...an application needing to be heard by a Judge. Of course this doesnt make the will a duly executed one, and until legislation is passed allowing video witnessing of wills, the best practice will still be to have the will witnessed by 2 witnesses who are physically in the presence of the testator. #will #estateplanning #succession
