25.01.2022 Proud to have worked on this project The Adnate hotel opens its doors in Perth Accor has opened the doors to its ninth Art Series hotel, The Adnate, in Perth’s city centre. Welcoming its first guests on Tuesday, the 250-room hotel was inspired by the multicultural portraiture of renowned Australian street artist, Matt Adnate, and features one of the world’s largest ‘mega murals’ - the tallest in the Southern Hemisphere, spanning 25 storeys. 23.01.2022 The Australian Hotels Association (WA) - alongside announcements from the Premier - have announced phase three restrictions that are coming into effect as of midnight next Friday - 5th June. What does this mean for all of us in the hospitality industry? New one person per 2 square metre rule will now apply... Venues will be allowed up to 100 patrons per separate area or room A new maximum capacity of 300 patrons per venue The requirement for alcohol to be served ancillary to a meal will be removed Patrons are allowed to be served at a bar, but must remain seated to be consuming alcohol Contact tracing requirements will remain and be required for each area or room in a venue This is a huge step forward in the right direction - and we are excited to see how this all unfolds! 21.01.2022 Under the new needs test in the Liquor Control Act WA the 400sqm limitation relates to the "retail area" of the store. There is a definition of that term, but exactly how it is calculated, and exactly what is included in the "retail area" may be subject to some interpretation.

21.01.2022 Olive Farm's new cellar door experience Olive Farm Wines, located in Perth’s Swan Valley wine region, has introduced a self-service ‘adults-only’ vending machine to its cellar door experience. The four Enomatic Wine dispensing machines allow visitors to try 32 different varieties of Olive Farm produced wine. The custom designed and built display tank uses argon gas, which preserves the quality of the wine once the bottle has been opened. With the assistance of staff, visitors are able to taste a set number of wines from the system by inserting a prepaid card, allowing the machine to dispense a measured tasting serve.

Instructions to close certain places of business, worship and entertainment: Under the Emergency Management Act 2005, the Commissioner of Police and State Emergency Coordinator, Chris Dawson, has issued directions regarding the closure of various establishments to the public in WA to limit the spread of COVID-16.... Owners, occupiers or people in charge of the following ‘affected places’ must close to the public for the period from 12 noon on 23 March to midnight on 13 April 2020. ‘Affected places’ are: A profit or not-for-profit business such as a pub, bar or club that supplies alcohol under a licence granted by the Liquor Control Act 1988 (WA) not including any part of the business that is a bottleshop; A hotel, whether licensed or unlicensed, but not to the extent that it provides accommodation, takeaway meals or drinks or a meal delivery service or any part of the hotel constituted by a bottleshop; A gym; an indoor sporting centre; a casino; a cinema or nightclub; an entertainment venue of any other kind; or a restaurant or café, other than to the extent that it provides takeaway meals or drinks or a meal delivery service; and A place of worship, other than for the purposes of a wedding or funeral. You can download the Commissioner’s full directions below. To ensure national consistency this Direction applies to local government venues and facilities. It affects libraries, indoor sporting venues, theatres and other cultural and sporting facilities that may be operated or managed by local governments or private operators. 16.01.2022 New changes restrict liquor barns to address community concerns Friday, 1 November 2019 New regulations restricting number of WA liquor barns take effect on November 2 Changes the first of their kind in Australia and were drawn up in consultation with key industry stakeholders ... Changes follow community concerns about the proliferation of large liquor outlets The State Government has introduced changes to the Liquor Control Act 1988 to reduce alcohol-related harm in the community by clamping down on the proliferation of liquor barns. New regulations that take effect from tomorrow (November 2) will not allow large packaged liquor outlets - of 400 square metres or greater - to be established within five kilometres (metropolitan area) or 12 kilometres (regional areas) of an existing large packaged liquor outlet of 400 square metres or more. The distances are calculated using the shortest route by road. Racing and Gaming Minister Paul Papalia said the changes are the result of ongoing community concerns and extensive industry consultation, and will provide certainty to liquor industry investors in Western Australia. The changes will still allow for 'greenfields' outlets to be established as a 'first mover', but no further large packaged liquor outlets will be allowed within the above distances. The changes are not retrospective - all existing venues will be unaffected, but they will not be able to increase the size of their retail sales area to more than 400 square metres if another large packaged liquor outlet is within the prescribed distances. Other amendments to the Act include allowing the Director of Liquor Licensing to assess whether consumers' needs are reasonably met by existing packaged liquor outlets when assessing a new application for an outlet in a local area. The changes were drawn up in consultation with key stakeholders including the Liquor Stores Association of WA, Australian Hotels Association (WA), the McCusker Foundation, WALGA, as well as a range of private companies and peak bodies. Comments attributed to Racing and Gaming Minister Paul Papalia: "These amendments to the Liquor Control Act 1988 were passed in July 2018 with overwhelming support. "They are the first of their kind in Australia and are a good example of community feedback leading to policy change. "They represent the most significant reforms in more than a decade - since the Labor Government's changes in 2007 which opened the small bars market in WA. "Importantly, they strike an excellent balance between liberalising the liquor environment for responsible licensees and consumers, as well as managing community expectations for particular types of venues."

15.01.2022 To support the liquor industry the Director of Liquor Licensing will grant occasional liquor licences to existing licensed venues for up to 6 months to allow the sale of liquor with a takeaway or delivered meal. Licensees with permanent licences of the following types will be able to apply: Restaurant Licence Small Bar Tavern Restricted... Hotel Restricted Club Restricted Special Facility Caterer. Packaged liquor will be limited to one bottle of wine and one 6 pack (beer, cider or pre-mixed spirits) per order (the six pack can be in any combination). The permitted hours for packaged liquor sales will be between 12 noon and 12 midnight. The sale of liquor can only occur between the purchaser and the licensee (i.e. not a third party on behalf of the purchaser). Applications will be fast-tracked and application fees will be waived. Application forms will only be accepted by email. If you would like help getting this in place, please message me.

Due to the ongoing events we have had to adjust the style of our catering to focus on supplying bulk readymade meals to both the community, and through donations we are providing meals to the frontline health services. We have started providing meals for Joondalup Health Campus, Sir Charles Gairdner Hospital and Emergency Services. We are also hoping to distribute to Perth Children’s ...Hospital, St John of God Subiaco and more locations. From the very start of having our initial idea to the delivery of the first week’s meals we have had enormous support and so much positive feedback it has been heart-warming. We are producing these meals at cost, not for a profit and have been working hard behind the scenes to get funding. A number of donations have been gratefully received from the local community and businesses, but in order to continue Cherry’s need more donations. We have the experienced staff, the commercial production kitchen and local suppliers on hand to produce 1000 plus healthy readymade meals a day if required, which are made fresh to eat now or freeze for later. 13.01.2022 For our clients who sell packaged (take-away) liquor in WA... COVID-19 response: Temporary changes to takeaway alcohol The State Government, in consultation with the WA Commissioner of Police, has introduced temporary restrictions on takeaway alcohol across the State, to ensure Western Australia is well prepared to respond to COVID-19 and minimise alcohol-related problems in the community. 25 Mar 2020... Temporary limits for takeaway alcohol to assist with COVID-19 response Ensuring our hospitals are well resourced to manage increased pressure Minimising alcohol-related problems during periods of social distancing Restrictions will be reviewed after two weeks The restrictions will be implemented for a minimum two-week period, and will then be reviewed. Under the changes, takeaway alcohol will be limited to the following amounts, per customer, each day: one carton of beer, cider or pre-mixed spirits; or three bottles of wine; or one litre of spirits; or one litre of fortified wine; or a combination of any two of the above (but not a combination of two of the same product). Existing takeaway restrictions in particular communities will remain in place. The new restrictions come into effect immediately from 10am today (March 25). They will be introduced for a two-week period, and will be extended or altered at any time if necessary See more

This comes in the aftermath of the November 2019 changes to the Liquor Control Act which introduced the reasonable requirements test for take-away liquor outlets. Strict enforcement of that new provision lead to refusals for venues like Hangawee, Northbridge, Commune Wine Store, Maylands and BWS Inglewoo...d. The soon to be built shopping centre in Martin can now proceed as planned.

12.01.2022 The WA licensing authority has announced that liquor licence renewal fees will be waived as part of $1 billion COVID-19 economic package Licensees will soon be contacted regarding the State Government announcement. 31 Mar 2020... Liquor licence renewal fees for 2020 will be waived and refunds provided for businesses that have already paid, benefitting around 5,500 businesses with a liquor licence.

09.01.2022 Just returned from a hearing at the Liquor Commission of WA for a review of the grant of a liquor store licence to Cellarbrations at Boddington. Canford acted for the applicant for the licence. I think we had a fair hearing.

06.01.2022 RESTAURANT & CATERING AUSTRALIA RESTAURANT INDUSTRY AWARD TEMPORARY VARIATIONS 1 April 2020 Background: In light of the current COVID-19 pandemic, the Restaurant & Catering Industry Association (R&CA) filed a joint application with the United Workers Union to temporarily vary the Restaurant Industry Award 2010 to allow greater operational flexibility for employers and employees. ... R&CA is pleased to advise that the application has now been granted by the Fair Work Commission. These amendments are to apply from the first full pay period starting on or after 31 March 2020 and operates until 30 June 2020 (unless an application for an extension to the changes is made and granted). This is a significant achievement affecting nearly 450,000 industry workers following weeks of active, collaborative work with the Australian Chamber of Commerce and Industry and the Australian Council of Trade Unions. If you require any further information, please contact R&CA on 1300 722 878. Key Award Changes: The key changes to the Award are: 1. Classification and Duties a. Employers may now direct employees to perform duties within their skill and competency regardless of their classification provided they have the relevant qualification (e.g. RSA Certificate). 2. Hours of Work a. A full time employee may have their contracted hours reduced to maximum of 60% of regular hours (e.g. a full-time employee can only be required to work 22.8 hours). Payment is to be made on a pro rata basis; b. A part time employee may work average hours between 60% and 100% of their guaranteed hours per week or per roster cycle; c. Employers will need to follow the standard consultation clauses when arranging the above. d. Employees will continue to accrue entitlements as per their full contract irrespective of their reduced hours. 3. Annual Leave a. An employer may direct an employee to take annual leave with 24 hours notice, although a shorter notice period may apply if agreed; and b. An employee may take twice as much annual leave at proportionally half the rate of pay of annual leave.

05.01.2022 Canford has successfully obtained a Special Facility Licence for Piccadilly Theatre. The venue will now be undergoing a multi million dollar upgrade to their theatre. A Special Facility Licence is available to venues that don't operate as traditional food and beverage spots (bars, cafes etc.). The grant has come in good time for the commencement of the renovation works. Congratulations to Piccadilly Theatre, and watch this space for updates!

05.01.2022 An article was posted this week by Broadsheet about a proposed liquor store on Railway Parade - called Commune Wine Store. Racing, Game and Liquor unfortunately knocked back their application for a liquor store licence reportedly because of the 'new reasonable requirements' test. The owners are currently seeking funding for a review to the Liquor Commission. The situation is very interesting and unfortunate because renovations for their venue was all done (by the owners no ...less) - and the second they got their licence approved, they would open their doors. Their experience highlights the importance of satisfying this new clause that now exists in liquor licence applications. 04.01.2022 From the AHA page From today, the Morrison Government’s Business Hotline - 13 28 46 - will be expanded to provide specialist advisers and extended hours to support small and medium businesses impacted by the COVID-19 pandemic. Operations at the www.business.gov.au 13 28 46 Contact Centre will increase from five days per week to seven days per week, and provide an additional two hours a day of support outside standard operating hours for the first month, answering calls from 7....00 am to 11.00pm AEST. The Government is rolling out comprehensive, targeted assistance in response to the COVID-19 pandemic and we want businesses who are looking for information to be supported. During these challenging times businesses that have been impacted by COVID-19 need readily available access to advice so they can fully understand the assistance available to them and their employees. 03.01.2022 Recently Racing, Gaming and Liquor Minister Paul Papalia appeared on ABC radio to discuss home delivery of alcohol. On that radio program it was acknowledged that home delivery of alcohol is currently permitted, and has been permitted from hotels and taverns for several decades. The Minister said he is looking at this issue with a view to amending the Liquor Control Regulations. He said he acknowledges there is public demand for this service, and said he does not want to ban ...the practice. (Something we put to his policy adviser some months ago) Jimmy Brings is an alcohol delivery service by Woolworth's which has been in place over East for some years now, but is now in WA. Authorised hotels, taverns and liquor stores within the metro area are now allowed to trade from 8am on the following Sundays: Sunday 13th December Sunday 20th December Sunday 27th December... Country stores may now trade from 10am to 10pm on the following Sundays 1st March 12th April 26th April 31st May 27th September 13th December 20th December 27th December There are some exceptions to this provision - in areas of liquor restrictions. A Restaurant & Catering Australia report argues that roughly 12,000 Australian eateries could close their doors for good. The beleaguered industry was already grappling with an overabundance of restaurants and cafes prior to the pandemic, along with soaring produce costs and several wage scandals. Fine dining restaurants are especially apprehensive as doubts surface about the eater's appetite for more conspicuous consumption when the economy reboots. Partial reopenings are also troublesome, as patron numbers limit takings but set-up costs remain high.
