25.01.2022 Malicious and deliberate destruction of child parent relationships must be addressed. As debate about the new parliamentary inquiry into the family law system continues, one family lawyer explains how he has witnessed numerous instances of baseless allegations of domestic violence to prevent the other parent’s time with their child. In the worst of cases, the withholding parent will use the lengthy delays to alienate the child such that they no longer want to spend time with the other parent. These are some of the most difficult and saddening cases we have to deal with. See article: https://www.lawyersweekly.com.au//26567-malicious-and-deli
24.01.2022 Separation can be difficult and challenging for everyone involved. We believe that the best way to deal with a relationship breakdown is outside of the Courtroom. We often find mediation the most effective and stress-free way to solving family law disputes. The great cost advantages aside, mediation can also: Be undertaken at any time ... Give all parties the right to be heard early on Save in emotional stress. See more

22.01.2022 When you fight, it's not you against each other, it's both of you against the problem.
22.01.2022 What is a parenting plan? A parenting plan is a written agreement that is dated and signed by both parties. I like to think of it as a post separation parenting road map. A parenting plan can address a range of issues including who your kids live with, who they spend time with, allocation of parental responsibility, arrangements for special days such as birthdays and holidays. It can address anything you would like it to address or anything you think needs addressing. It can’t be enforced by a court if one parent does not comply with it. If either parent decides to go to court then the court must consider the terms of the latest parenting plan when making parenting orders

22.01.2022 There is an old saying: Nobody plans to fail, but many fail to plan. Nobody gets married with a view to getting divorced, so why not consider a Binding Financial Agreement, otherwise know as a Prenup. You can have peace of mind now and avoid fighting it out in court in the future.
22.01.2022 https://www.smh.com.au//where-sydney-s-suburbs-are-greying Cammeray and Cremorne have been pinpointed as some of Sydney suburbs that are greying. As Australia’s population ages, there is an increasing demand for specialist and bespoke legal services addressing issues facing the elder community and their loved ones. In general, there are four main areas of concern for elder or senior people, including long-term health care issues, the management of personal affairs, elder abuse and estate planning and administration. As a law firm with strong ties to the Cammeray community we are well placed to provide guidance in this growing area.

21.01.2022 When separation occurs you are going to be emotionally vulnerable. You are dealing with a whole range of emotions. Anger, fear, regret, sadness will probably visit you at some stage. You won’t always be yourself and you won’t always think straight. Your family and friends mean well but they will be partisan, on one side or the other. Their input won’t always be helpful. Finding someone completely objective, unknown to you and your partner previously, is a great way of getting... a fresh and independent perspective and helping you marshal your thoughts for the future. This might cost you some money in the short term if you decide to talk to a counsellor but in the long term it will help. This can be therapeutic and restorative. It can lead to better decision making. This will save you money and help you feel better sooner. Photo by Søren Astrup Jørgensen on Unsplash
21.01.2022 ...that’s what any kind of relationship break up is, it is a trauma, so we need to help them move through it. the last thing we want to do is get stuck in a limbo where you are waiting for someone else to decide for you, and that’s where the whole idea of an interdisciplinary collaborative practice is, you get the lawyers in the room, you get our financial planners in the room, you get your counsellors in the room, whatever experts are needed to sort out your particular sit...uation, all work together for the better outcome of the family... Sarah Mac’s interesting conversation with Psychologist Bernie Bolger andfamily lawyer Jamie Burrekett, exploring civil and collaborative separation. Listen here: https://www.abc.net.au//nig/collaborative-divorce/10979806
20.01.2022 Breaking up in Australia is expensive. In court proceedings you spend a lot of money, you spend a lot of money going over the past: who did what and when. Collaborative Law can lead you and your family to a compassionate ending and a healthy new beginning. A divorce without Court leads to better outcomes for families, allowing you to be future focused.

19.01.2022 Meet Lilly. Lilly was admitted as a solicitor in early 2020 and has worked at Capelin Law since 2018. She is a valuable member of the team and is involved in most of the firm’s family law and estate planning matters. While getting herself through university and working at Capelin Law Lilly also managed a very busy inner city retail jewellery store. As well as being very organised and having great people skills, Lilly has developed awesome tech skills. She has been largely re...sponsible for the creation, development and maintenance of William our estate planning bot, which allows our clients to interact with us online. Lilly hails from Bathurst, NSW originally but has now made Sydney her home. As well as helping Andrew on most matters, Lilly is available for estate planning and family law consultations. #familylaw #familylawyer #capelinlaw #Sydney #northshore #cammeray #court #solicitor #estateplanning #estate #planning #estateplanninglawyer #sydneybusiness #divorce #mediation #separation #familylawfirm #marriage #child #attorney #divorcelawyer #consultation #client #advice #financialfreedom #legaladvice #will #trust #estatelawyer #meeting #team
19.01.2022 Co-parenting after separation can be challenging, especially if your relationship didn’t end on good terms. For the well being of the children, maintaining effective and amicable communication is very important. One of the newest apps to assist with co-parenting is Divvito https://divvito.com. It can be downloaded to all smartphones. Divvito helps parents connect on a private messenger platform where they can discuss arrangements. It uses AI to make sure the communication is positive and child focused. We recommend it to all our clients. Check it out by visiting https://divvito.com
19.01.2022 New on the blog! FamilyProperty is a tool which we often utilise to assist our family clients. Chloe discusses some of the features we love most and unpacks how the platform streamlines the entire settlement process.
19.01.2022 Did you know that in Australia, there is no need to provide any reasons for divorce other than that the relationship has broken down irretrievably. If you’ve been separated for more than 12 months the court takes this as evidence of the fact, and even if you still live under the same roof you can still obtain a divorce provided you swear to the separation in your divorce application.

18.01.2022 A man drought in Cammeray? Australian Bureau of Statistics data shows that Cammeray is amongst Sydney’s suburbs with the lowest male-female ratios in part due to divorced and separated women outnumbering divorced and separated men. As a family law firm with strong ties to the Cammeray community we can provide advice and support to men and women on Sydney’s north shore who are experiencing or considering separation. 17.01.2022 Andrew has been to court many, many times. He knows the toll it takes on people financially and emotionally. These days we prefer to collaborate, negotiate and mediate! Get in touch to find out more and end your relationship with respect and dignity
17.01.2022 We aim to keep our clients OUT of court! Mediation can be a great process to help both parties reach workable agreements, quickly and cost efficiently.
17.01.2022 Social media and a family law property division what can go wrong? Sometimes social media posts can aggravate attempts between parties to come to an agreement. Let’s say that Jane has posted a picture of herself holidaying in a flash resort, or maybe Joe has put up a post of what looks to be a new car. In property division matters where each party is required by law to make full financial disclosure of their financial position, posts such as these can lead the other party to question whether full and frank disclosure has been given

14.01.2022 Andrew was admitted as a solicitor in 1996. He also practiced as a barrister for about 10 years which makes him very competent and confident in a court room! Ironically, Andrew now handles very few litigation matters these days, preferring to focus on helping families resolve their issues collaboratively. Andrew finds collaborative practice to be a very fulfilling part of the work that he does and is passionate in his belief that it gives better outcomes for families. Andrew’s other passion is playing golf.

11.01.2022 In Australia, for a divorce application to go ahead it must be proved to the court that the relationship has broken down irretrievably. How so? This is demonstrated by a period of separation of 12 months immediately before filing the divorce application. If the parties became reconciled at any point during the separation period this would affect the 12 month period of separation
11.01.2022 New on the blog. Andrew explains how can significant life events impact on your will.

11.01.2022 New year new you! Have you been thinking about getting a divorce? Don’t forget you need to wait 12 months from the date of your separation to make an application with the court. However, you can start working out property and parenting matters right away. Get in touch with us to organise a free no obligation guidance call this new year.
10.01.2022 Contesting a Will in NSW. The law requires that certain people be properly provided for in a Will, and we are experts in helping people get what they are entitled to. We can help you write your will or challenge a Will or defend a Will. Many Wills are not legally binding. A court can make orders to redistribute the Estate to pay money where people have been unreasonably left out, or are named in a Will but not properly provided for given the circumstances.
10.01.2022 Don't be discouraged by a failure. It can be a positive experience. Failure is, in a sense, the highway to success, inasmuch as every discovery of what is false leads us to seek earnestly after what is true, and every fresh experience points out some form of error which we shall afterwards carefully avoid. John Keats
09.01.2022 Have you recently ended your de facto relationship? In some instances of de facto relationship breakdown one partner may deny the existence of a de facto relationship on a genuine domestic basis. But where does this leave you? The onus is on you to prove that your relationship existed under the laws of your State or Territory. In order to prove a relationship existed, the Court considers these 9 factors: (1) the duration of the relationship; (2) the nature and extent of their... common residence; (3) whether a sexual relationship existed; (4) the degree of financial dependence or interdependence and any arrangements for financial support between them; (5) the ownership, use and acquisition of their property; (6) the degree of mutual commitments to a shared life; (7) whether the relationship is or was registered under a prescribed law of a State or Territory; (8) the care and support of children; and (9) the reputation and public aspects of the relationship See more
09.01.2022 Australian law focuses on the rights of children to have an ongoing relationship with both parents so that separating from your partner or spouse doesn’t mean that you are separating from your child or children. Although the terms ‘custody’, ‘residence’, ‘contact’ and ‘access’ are no longer used much by lawyers today, the issues behind the jargon are still on the top of the list of concerns for separating couples, namely: - Who will the child or children live with?... - How will they spend time with the other parent? - How will both parents be kept in the loop in regard to important decisions such as education and health? We can help you find the best outcome in an uncomfortable time.
08.01.2022 We are excited to introduce William, our new simple estate plan builder, created by us. Even though he is a legal chat bot, interacting with William is just like talking to a human lawyer. 07.01.2022 Q: How often should I review my Will? A: You should certainly review your Will after any major life events, such as marriage, divorce, property purchase or sale, a death of a beneficiary or if your assets change significantly. We also recommend that you take a look at your Will every five years just to make sure that it is still the best instrument for you and for your family. Photo by Álvaro Serrano on Unsplash
06.01.2022 https://www.abc.net.au//the-true-cost-of-a-day-in/10610408 NSW-based solicitor Kayte Lewis says settling a family court matter in mediation typically costs around $20,000. If it went to litigation, the cost would be more like $100,000. The above quote was extracted from an article that appeared on www.abc.net.au the true cost of a day in court, which highlights how the cost can be more emotionally, and financially draining than you might think.
06.01.2022 Time for a new Will? We recommend reviewing your Will and estate planning documents every 2-3 years or after any major life events, such as marriage or divorce. Capelin Law offers an easy to use online questionnaire to help get you started via our website!

06.01.2022 Did you know that in Australia your superannuation fund does not actually form part of your estate and is therefore not subject to the terms of your Will? For some Australians, the superannuation balance can be one of their biggest assets. This fact really highlights the importance of having an up to date and valid Binding Death Benefit Nomination in place to ensure peace of mind and ensure that your Super is paid to the person or persons you wish after your death. Keep in mind however that superannuation can only be paid to a dependent such as a spouse, de factor or child or a person in an interdependency relationship with you.

06.01.2022 Once court has been ruled out, the focus for all concerned is no longer about winning and losing. Rather, the energies shift towards getting to a mutually acceptable agreement for the family as a whole. Interest-based negotiation techniques allow parents greater scope to focus on their children's needs. By working with other collaboratively trained professionals - such as child psychologists, counsellors and therapists - clients can begin to develop a different relationship with each other, learn the business of parenting apart in a way that promotes the wellbeing of their children, and thereby preserve the concept of family.
06.01.2022 Here at Capelin Law we are always looking to fine tune our legal knowledge. 04.01.2022 I did a Q&A with Karen from Legally Yours recently.
04.01.2022 Did you know that your Will gives away the assets that you own as at the date of your death? If for example in your Will you made provision to leave Cousin Mary your antique rug, but you no longer owned that item at the date of your death, then Cousin Mary would simply receive no gift at all and would not be entitled to be compensated for the value of the rug. In the Law of Wills this is referred to as Ademption or Ademption by extinction
04.01.2022 One of the loveliest testimonials we’ve received recently a beautiful bunch of flowers from a happy client.
04.01.2022 Collaborative Practice is law without litigation, and mediation with advice. It is a voluntary dispute resolution process where both parties, their lawyers and a collaborative coach make a promise to resolve a dispute without resorting to court. That’s right everyone agrees AT THE START we won’t go to court or even threaten to. How Awesome is that? One of Andrew’s goals in establishing Capelin Law was to deliver better outcomes to families facing the breakdown of their relationships. By offering alternative dispute resolutions such as collaborative practice, Capelin Law can offer better and more workable outcomes for our clients and their families

03.01.2022 A family law matter litigated through the Australian Courts can typically cost up to $100,000. At Capelin Law, we are firmly of the view that if you are going to invest in a process to resolve issues when you separate then putting that money into one that is positive and helpful instead of one that is destructive is a good idea. Collaborative law is one such process that take a constructive approach and puts the focus on the future, not the past.
02.01.2022 Going to court should be an absolute last resort. Court proceedings are expensive, nasty, emotionally draining and not rewarding. Ultimately if you are one of the very small number of cases which proceed to a final hearing, you will have a decision imposed on you by someone who doesn’t know you, or your children. Even if you win you will come away with certain aspects of the process and the decision that you are not happy about nor comfortable with. Ask your lawyer about other options rather than going to court. There are several other approaches you can try. Mediation, negotiation and collaboration are a few. Photo by Anna Sullivan on Unsplash
