Two articles which look at the recent Court of Appeal decision of Ku-ring-gai Council v Chan [2017] NSWCA 226. The purchasers Chan & Cox purchased a property where the vendor had carried out substantial work as an owner-builder. ... The Council was appointed as the certifier and issued an Occupation Certificate. Council however failed to ascertain during its inspection of the property that the property contained structural defects and did not comply with the engineer’s drawings or the approved plans. The purchasers asserted that a certifying authority owed them as successors in title a duty of care when performing an inspection and to identify defects and if defects are found not to issue an Occupation Certificate.
