25.01.2022 FAQ WITH C & B 1. Am I eligible for exemptions from stamp duty? There are numerous exemptions available for different circumstances. The most common exemption is for a first home buyer purchasing their first home. This is available for a purchaser if the individual and/or their spouse or a couple have never owned a residential property in Australia. To be eligible the following criteria must be met:... - You must be over the age of 18 years. - You must be an Australia Citizen or permanent resident. - You must occupy the property as your principal place of residence for a continuous period of 6 months commencing within the 12 months of the completion date of the Contract. 2. Why am I paying the vendors rates and water accounts? Rates and water accounts being paid on settlement appear on the settlement statement. This is collected from the Vendors amount due to them on settlement. Within the settlement statement there will be an adjustment for the purchasers shares of the rates and water from the date of the settlement up until the end of the instalment period. A payment is then made upon completion so that upon settlement the rates and water charges are paid up to date. 3. Can I sell my farm and keep my water entitlements and shares? Yes you can retain your water entitlements and shares which you can either transfer to another farming property that you own or you can create a customer only account with your irrigation company. 23.01.2022 Cater & Blumer's FAQ with William Glowrey DRIVING OFFENCES 1. What am I being charged with? ... If you are charged by the police in relation to driving and alcohol, it is likely that you will be charged with one of the following offences:- - Low Range Prescribed Concentration of Alcohol (PCA): reading between 0.05 0.08; - Mid Range PCA: reading between 0.08 0.15; - High Range PCA: reading between 0.15 7; - Novice Range: 0.00 7 for L, P1 or P2 drivers; - Special Range: 0.02 7 for certain drivers; and - Driving under the influence of alcohol: if the police can establish that at the time of driving you were impaired by alcohol. 2. Will the police suspend my licence straight away? All of these offences carry on the spot suspensions. Generally, this will be finalised in Court with a disqualification which will back date to when your licence was suspended. You may wish to discuss an appeal with your solicitor. 3. Can I get a work licence to drive to and from work? No. Work licences no longer exist in New South Wales. 4. What happens if I refuse to give a breath sample? You are required by law to give a breath sample when directed. Failing to do so is an offence with the penalties being the same as a High Range PCA, irrespective of whether or not you have been drinking. 5. What happens when I get arrested? You will be taken to the police station. You will then be asked to provide another breath sample which will be the Blood Alcohol Concentration you will be charged with. 6. What if I am not guilty? It is possible to challenge the reading taken by the police. It is important to discuss this with your Solicitor and have your rights explained to you.

17.01.2022 BORDER CLOSURE TO PROTECT NSW From 12:01am Wednesday 8 July 2020, the NSW government will close the NSW border with Victoria. Under the Public Health (COVID-19 Border Control) Order 2020, people who have been in Victoria within the last 14 days will not be allowed to enter NSW unless they have a border entry permit or are exempt. ... Returning NSW residents are required to go in to 14 days self-isolation. Penalties for breaching the Order: A person found in breach of the public health order faces up to an $11,000.00 fine and/ or six months imprisonment. The standard deposit is 10% of the purchase price. However, in some circumstances the vendor may be willing to accept a reduced deposit, for example a 5% deposit. Alternatively, you can also discuss with your bank or broker the option of a deposit bond, which is a bond that is issued upon unconditional finance approval at a fee. 2. Should I get a pest and building report? It is a personal choice. However, our advice is that you should obtain a pest and building report to ensure that you are aware that your purchase is free from infestation, and that the building is structurally sound. This ensures you are aware of any immediate work which needs to be carried out prior to exchange of contracts. 3. Do I need a Contract of Sale to market my property for sale? If you are intending to sell a residential property (house, block of land, unit), you are required by law to have a proposed Contract of Sale available for review by the Purchaser. This includes if you are intending to sell privately, or listing the property for sale with your chosen real estate agent.

Exchange of contract is the dating of the Contract of Sale, making it legally binding on the parties. Upon exchange, the completion date can be calculated. In most cases, settlement is 28 days from exchange. 2. Should I review the contract with my conveyancer or solicitor before bidding at auction? Yes, we advise that you should. If you are intending on purchasing a property at auction, you should review the contract with your legal representative before attending the auction. If you are the successful purchaser, you will be required to immediately sign the contract, pay a deposit, and contracts will be exchanged. There is no cooling off period in an auction contract. If you review the contract after having signed the contract at auction, and there are undesirable conditions or unknown easement/restrictions, you will not have a right to rescind the contract. 3.
