25.01.2022 ? The death of a beloved family member or friend is one of life’s most stressful times. It is often difficult to think about what needs to be done immediately following a death. If you follow our recommendations below, you can remove at least a small part of that initial stress.... The first matter to attend to is to organise the funeral. Before you finalise the arrangements you should always locate a copy of the deceased’s will to find out whether your loved one or friend has specified any specific wishes in relation to the funeral and, in particular, whether they would like to be buried or cremated. At the same time that you are organising the funeral you should ensure that the deceased’s property and belongings are safe and secure. If the deceased is receiving any government benefits or pensions, it is a good idea to advise the relevant departments of the passing as soon as possible. This will ensure that those payments are stopped at the earliest time meaning that the deceased’s estate won’t have to pay any money back. After the initial shock of the passing, and the grief associated with the holding of the funeral, there is no urgency to commence estate administration. In fact, nothing can be done until the death certificate (which is generally organised by the funeral home) has issued. You will therefore have some time to remember your loved one/friend and begin the process of dealing with your loss. Once the death certificate has issued, we recommend that, when you are ready, you make an appointment with a law firm that is experienced in estate administration. When you attend that appointment, you should take with you the death certificate, the deceased’s will, and as many details as you are able to regarding the assets and liabilities of the deceased person, including bank accounts, property, motor vehicles, shares, superannuation, life insurances and any loans that they had. If you have any documents regarding these assets and liabilities, including bank statements, title deeds, registration papers, share certificates and life insurance policies, you should bring them to the appointment. The law firm that you consult will then be able to provide you with more detailed advice about the procedure moving forward.
