21.01.2022 Ive had the same conversation around casual employment for the second time this week. It appears there is quite a common misunderstanding around how casuals SHOULD be employed. A true casual is one that you call in as and when you need them. What is not a true casual is when they work the same hours and days week in, week out and have the expectation of ongoing work ie. they appear on longer term rosters.... More than 12 months ago, the Fair Work Commission (FWC), as part of the 4 yearly review of Modern Awards, issued a decision confirming their intent to insert a casual conversion clause into Modern Awards which didnt contain such a provision. Recently, the FWC advised the model clause had been finalised and will become operative from 1 October 2018. The model clause will be inserted into 84 Modern Awards and permits casuals to be able to request to convert to full-time or part-time employment if the casual employee has been regularly employed for the previous 12 calendar months. Regular casual employees will have the right to request conversion. A regular casual employee is an employee who has worked a pattern of hours on an ongoing basis which, without significant adjustment, could continue to be performed in accordance with the full-time or part-time provisions of the relevant award. The onus is on the employee to write to the employer to request conversion if they meet the definition of a regular casual employee after 12 months (or more) service. An employer may refuse to convert a casual employee to permanent status on reasonable business grounds only after there has been consultation with the employee. Where an employer refuses a request to convert, the employer must provide the employee with written reasons within 21 days of the request being made. To comply with the model clause, an employer will be required to furnish every casual employee with a copy of the model clause within the first 12 months of the employees first engagement to perform work. The model clause conveys a transition period for casual employees employed as at 1 October 2018; employers have until 1 January 2019 to furnish such employees with a copy of the conversion clause. A number of Modern Awards which already include casual conversion provisions will not be affected by the introduction of the model clause for now. 14 Modern Awards will from 1 October 2018, contain a modified version of the model term. 09.01.2022 Recent National minimum wages increase From 1 July 2018, the national minimum wage will increase in Australia on 1 July 2018 by 3.5% The new national minimum wage is $719.20 per week, for a 38-hour week or $18.93 per hour.... The increase applies from the first full pay period starting on or after 1 July 2018, for employees on the national minimum wage or a modern award.
