08.01.2022 Are you re-married? Do you have a valid Will? Did you know that your Will (if you have one) gets automatically cancelled when you re-marry? This puts you in the same position as if you dont have a Will. Which is intestacy. In an intestacy (which is another way of saying I dont have a Will) you dont get to decide who gets what. Instead, the NSW Government has decided the pecking order of inheritance.... So, on an intestacy, this is the order of inheritance chosen by the Government for the person without a valid Will: 100% to the surviving (living) spouse (even if you have kids together), BUT if you have kids from a prior marriage (and none of your own), things get a bit different ... Your surviving spouse gets the first $350,000, then shares the rest of your estate with the children from the first marriage, even if they are adults. On top of that, the surviving spouse might not be able to stay in the matrimonial home, it might need to get sold to payout the children from the first marriage. If that is not what either of you want, you need a valid Will, with different instructions.
