24.01.2022 Ask CGW family lawyers Separating from a de facto partner or spouse is an incredibly stressful event. It can happen suddenly, for example, when an affair is discovered, or it can be a slow winding-down of what started as a blissful and loving union. In either case, emotions run high and people are often justifiably fearful that their formerly beloved partner may unilaterally withdraw funds from joint bank accounts for their own benefit. This inevitably leads to both parties considering whether they should access the funds first to preserve, or spend, them before the other can.

A prenup (referred to as a ‘financial agreement’ in Australia) is the most the law has to offer a spouse wanting to protect their wealth. 10.01.2022 Ask CGW family lawyers If a couple negotiating their financial deal cannot agree upon the value of an asset that one or both wish to retain, the Australian family law system requires them to obtain independent, expert evidence about the value for example, of a real property or business. The Rules mandate that, at least at first, they must agree upon, or the court may order, the appointment of a single expert to value the asset.... When the single expert releases their valuation report, it is common that one party is happy with the valuation and the other is not. Naturally, whichever party wants to retain the asset being valued will prefer that it be valued as low as possible, and vice versa.
