22.01.2022 WILLS and SUPERANNUATION Many people are of the belief that Superannuation is covered in your Will. This is incorrect. Your Will covers assets you own personally. Your Superannuation is held for you in Trust by your Super Fund and is governed by Superannuation Law. Different rules apply and your Super Fund should be kept up to date with your instructions.... The type of nomination you make is most important. Some nominations may lapse after three years. Check with your Super Fund to ensure you have a "non lapsing binding nomination". The process of nominating a beneficiary will depend on your Super Fund: talk to your Provider to ensure that your beneficiaries will not be paying tax. The ATO website has full information. Remember a Power of Attorney only comes into effect if you are unable or do not wish to make decisions for yourself. This will commonly be your spouse, a child or children. However, you are not restricted and it may well be an Executor of your Will or close friend.
