25.01.2022 Home Builder Scheme Applications Finally Released in NSW. . The Home Builder Scheme provides eligible owner occupiers with a grant of $25,000 to build a new home, substantially renovate an existing home or buy an off the plan home/new home. A new home is one that has not previously been sold or occupied as a place of residence, (e.g. spec build) and where construction commenced on or after 4 June 2020. . The eligible contract must be signed between 4 June 2020 and 31 December... 2020 (inclusive). Construction need not commence prior to 31 December 2020, however, must commence within three months of the contract date. Further, construction cannot have commenced before 4 June 2020. . 25.01.2022 About a year ago we had the privilege to meet a lovely lady who had then been diagnosed with cancer. We helped her with drafting her will. During the process we fell in love with her sense of humour, her passion for painting and story telling. These are some of the cards of her paintings that she dropped to our office to give out to people. . We received a call this week from her family to advise that she had lost her battle with cancer. We met her family today and we shared ...laughs and stories about how much of an impression she left on everyone in the office. She will be dearly missed. . She left us a frame with her painting in it. It will forever remind us to enjoy life to the end. Regardless of what cards you have been dealt, you have the choice to either push through or give up. 18.01.2022 Not all Oral Agreements Are Enforceable. . Today our office successfully defended against a claim brought before the Local Court in relation to the enforceability of a series of oral agreements between two former friends. . The Plaintiff sought to enforce a number of alleged oral agreements relating to work and assistance provided by him to a friend in exchange for financial compensation.... . Our office argued against the enforcement of the agreements on the basis that any oral agreement between parties would require the necessary elements of a binding contract including the existence of an offer, acceptance of that offer, consideration for the offer, certainty of terms, and the intention to enter into a legal relationship. . The Court found that in the absence of clear terms and any evidence of an offer having been made and accepted prior to work being completed, it could not be established that a legally binding contract had existed between the parties. It was also established that there was no intention to formally be bound by the agreement. . We successfully defended against the claim on behalf of our client and were awarded the maximum costs permissible in the Local Court. . 03.01.2022 NSW is pausing stamp duty for first home buyers, as it aims to boost housing construction though the pandemic. . The New South Wales state government is temporarily halting stamp duty on new homes under $800,000 for first home buyers, as a way to help create employment and support housing construction during the pandemic. . Stamp duty is a tax which is paid on top of a homes purchase price often an extra cost to home owners of tens of thousands of dollars.... . More than 6000 first home buyers are expected to benefit from the halt on stamp duty. It is set to boost construction and job creation in the state. . The state governments changes mean the threshold on stamp duty will rise from $650,000 to $800,000 and the concession will drop on higher values, ending at $1 million. . The threshold will also rise on vacant land from $350,000 to $400,000 before ending at $500,000. . These changes, however, are only for newly built homes and vacant land. They kick off on August 1 and will last for 12 months. .
