20.01.2022 Migration Program Planning levels 2020-21 released ====================================== The Migration program is set annually, with the total places available capped at a ceiling of 160,000 for 2020-21. The total program is broken down into the following streams:... Skill designed to improve the productive capacity of the economy and fill skill shortages in the labour market, including those in regional Australia. The majority of the places in the program are in the Skill stream (79,600 places in 2020-21, 50.7 percent of the program). Family is predominately made up of Partner visas, enabling Australians to reunite with family members from overseas, and provide them with pathways to citizenship (77,300 places in 2020-21, 49.2 percent of the program). Special Eligibility this covers visas for those in special circumstances. This can include permanent residents returning to Australia after a period away and is the smallest stream (100 places in 2020-21). At least 3,000 Child places will be available in 2020-21. 19.01.2022 Transitional arrangements for COVID affected SC 457 TRT applicants =========================================== Transitional operation of regulation 5.19 for certain 457 visa holders Amendment 2020 amends IMMI 18/052 to provide concessions for specified SC 457 holders whose work hours were reduced or were required to take unpaid leave due to the COVID pandemic. The effect of this Instrument is that the period of time required to be employed in the occupation and the position f...or TRT stream SC 186/187 nominations and visas, will not be affected by the visa holder working reduced hours or being on unpaid leave during the concession period, as a result of the coronavirus pandemic. The required period of employment prior to applying for these visas will include any period of reduced work hours or unpaid leave during that period. The concession period is defined in Reg 1.15N(1) as commencing on 1 February 2020. This Instrument introduces two new definitions: Coronavirus reduced work period (subsection 7A(3)) - for the purposes of Reg 5.19(5)(f) is defined as: => a period during the concession period, and => during the period of 4 years (or 3 years for grandfathered SC 457s) immediately before the application was made, and => throughout which the person was employed in the occupation for which the SC 457 or subsequent SC 482 was granted for Reg 5.19(5)(e), and => throughout which the employment was other than on a full time basis but would have been full time if not for the coronavirus pandemic, or => the person was on unpaid leave from that employment due to the coronavirus pandemic. Coronavirus unpaid leave period (subsection 7B(3)) - for the purposes of Reg 5.19(g) is defined as a period that: => occurred during the concession period, and => during the period of 4 years (or 3 years for grandfathered SC 457s) immediately before the application was made, and => throughout which the person was employed in the occupation for which the SC 457 or subsequent SC 482 was granted for Reg 5.19(5)(e), and => was on unpaid leave from that employment due to the coronavirus pandemic. This amendment applies to applications: => made on or after 1 February 2020 and before 24 November 2020 and not finally decided, or => applications made on or after 24 November 2020. 18.01.2022 NSW Skilled Work Regional visa (subclass 491) UPDATES =========================================== 2020-21 Financial Year Update:- The NSW Government’s limited number of interim nomination places for the 202021 financial year have been exhausted. We are currently awaiting confirmation of an additional allocation of places from the Home Affairs for the remainder of the financial year.... Regional Development Australia (RDA) offices will shortly commence assisting NSW Treasury managing applications for NSW nominations for the subclass 491 visa once the additional allocation has been confirmed. Under this new arrangement, each RDA will be responsible for setting their own eligible skilled occupations for nomination and accepting and assessing nomination applications. Information on applying for nomination through participating RDAs, including eligible skilled occupations, will be made available on their respective websites. Nomination Criteria for a 491 visa in NSW will remain consistent across all regions and can be found below. Skilled visas- Invitation rounds occur ongoing throughout the financial year. In line with Home Affairs' direction, we will only invite applicants in selected health, ICT and engineering occupations, and who currently reside in NSW. Please note that as a result of COVID-19 and significant reductions in Australia’s Migration Program Planning Levels, the chances of being nominated are currently low and you must meet the published nomination criteria to apply. Nomination criteria- You must meet the all criteria in one of the following three streams to be eligible for NSW nomination: Living and working in regional NSW; recently completed study in regional NSW; or living and working outside of regional NSW. 14.01.2022 New requirement to learn English to maximise job prospects ============================================ The Morrison Government is introducing new requirements for partner visa applicants and their permanent resident sponsors to make reasonable efforts to learn English. ... English is our national language and is critical to getting a job, fully participating in our democracy and for social cohesion. Only 13 percent of those with no English skills are in work compared to 62 percent of those who speak English well. We also know that without sufficient English language skills, migrants are particularly vulnerable to family violence and other exploitation and are less likely to know how and where to seek assistance. In the past decade, the number of people in Australia not speaking English well or at all has risen sharply and is reaching a million people, with about half of those being of working age. Earlier this year, the Government announced the removal of limitations on migrants‘ access to free English language classes through the Adult Migration English Program (AMEP). Migrants can now access as many hours as they need to reach vocational English. As part of this week’s Budget, the Government has announced new requirements for partner visa applicants and permanent resident sponsors to make reasonable efforts to learn English. Partner visas constitute 90 percent of the family stream of the permanent migration intake. The skill stream already has English requirements. From late 2021, new partner visa applicants and permanent resident sponsors will be required to have functional level English or to demonstrate that they have made reasonable efforts to learn English. People will be able to demonstrate this through, for example, the completion of 500 hours of free English language classes through the AMEP. Most partner visas are a provisional visa of two years before becoming eligible for a permanent visa. The requirement will have to be met at the time of the granting of the permanent visa. While the ability to speak multiple languages is a great asset for an individual and for Australia, a person will struggle to fully participate in our society and democracy without basic English. These new measures will provide further opportunity for migrants and new citizens to maximise their opportunities in Australia. 14.01.2022 Changes to the Australian Citizenship Test ******************************************** From 15 November 2020, there will be an updated Australian Citizenship Test with a clear focus on Australian values. Acting Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs Alan Tudge said the test would be updated for the first time in more than a decade to include a dedicated section on Australian values.... The updated Citizenship Test will have new and more meaningful questions that require potential citizens to understand and commit to our values like freedom of speech, mutual respect, equality of opportunity, the importance of democracy and the rule of law. The updated Citizenship Test will comprise 20 multiple-choice questions, including five questions on Australian values. A person will be required to correctly answer all five of the questions on Australian values, with a mark of at least 75 per cent overall, to pass the test. There will be no changes to the English language or residency requirements for citizenship. An updated version of the Australian Citizenship: Our Common Bond resource is now available for download to assist people to prepare for the test. This includes information on the new Australian values component and an updated practice test. More than 2500 people will receive Australian citizenship at more than 100 ceremonies across the country today. They will join the record 204,000 people who became Australian citizens last year. Despite the restrictions of the COVID-19 pandemic, since 31 March 2020, more than 85,000 people from every state and territory have become Australian citizens in online ceremonies. Citizenship testing has also resumed across Australia, with the exception of Victoria. From 30 October 2020, most new visa and citizenship applicants will be required to affirm the updated Australian Values Statement (AVS). The updated AVS will better reflect the shared values of Australian society, including the rule of law, freedom of religion, freedom of speech, freedom of association and equality of opportunity for all people in Australia. 14.01.2022 Outcomes of the 2019-20 Migration Program ================================== The Government has published the detailed outcomes from the 2019-20 Migration Program. The permanent migration intake was 140,366 in 2019-20.... Seventy per cent of the visas were granted through the skilled stream (95,843 in total), including 4,109 places under the highly skilled Global Talent Independent program, launched in November 2019. There were 23,372 regional visas delivered, from the 25,000 places allocated. This compares to 18,308 regional visas granted in 2018-19 an increase of 27 per cent. There were 41,961 visas granted in the Family program, including 37,118 Partner visas. Two-thirds of permanent visas were granted to individuals already in Australia who transitioned from a temporary visa to permanent residency. There were also 13,171 visas granted in the Humanitarian Program in 2019-20, including 4,765 visas (45 per cent) for those who were referred for settlement in regional areas. The size and composition of the 2020-21 Migration and Humanitarian programs will be considered in light of the developing COVID-19 situation and announced as part of the Budget process in October.

Each RDA office will accept and assess applications, and determine eligible occupations for their respective regions; however, nomination criteria is consistent across all regions. 11.01.2022 Protecting partner visa applicants against family violence ========================================= The Morrison Government is strengthening the Partner visa program to further protect vulnerable migrants from people who commit violent crimes against women and children. Family violence is unacceptable and will not be tolerated under any circumstance.... It doesn't matter who you are, where you come from, whether you are here on a visa or have Australian citizenship no one should be trapped in a violent relationship. Sadly we know some Partner visa applicants, particularly those with low English proficiency, are particularly at risk. They are often less likely to have an established support network in Australia, less likely to understand Australian laws and less likely to know how and where to seek assistance. To counter this, the Government will extend the family sponsorship framework to Partner visas, which will require an Australian citizen or permanent resident sponsor of a Partner visa to be assessed against character and sponsorship obligations and approved before a visa application can be made. It will also require sponsors to agree to certain results of their character checks being shared with their partner prior to the visa application being lodged. This may include information indicating a potential threat, such as charges and convictions of a violent nature. This ensures their partner can make an informed decision about whether or not to proceed with the visa application, especially in circumstances where children are involved. It also means applicants can feel empowered to walk away from a potentially violent relationship based on the information shared, before they lodge and pay for the visa application. The changes build on existing provisions in Australia's migration laws to allow provisional Partner visa or Prospective Marriage visa holders who experience family violence to continue with their permanent visa application even if their relationship breaks down. New requirements, announced last week, for Partner visa applicants and their permanent resident sponsors to make reasonable efforts to learn English will also support migrant women and families. Changes to the Partner visa framework and English language requirement will come into effect in late 2021 and will apply to new applications only. 11.01.2022 ***SC 485 Temporary Graduate Visa Changes*** ===================================== Two recent issues with the SC 485 Temporary Graduate visa program have caused concern and disruption for applicants. The announcement that SC 485 visa holders would be eligible for a second visa if they had studied and then lived and worked in a regional or other regional area for two years, has led to questions from applicants as to whether the applicant must have undertaken their full course... at a regional or other regional educational institution. The applicant must have 'graduated' from a regional or other regional education institution. It is not confirmed yet whether an applicant may have undertaken part of their course at a non regional institution and transferred to a regional institution before they graduate. Applicants will be informed when clarification is received from the Department. The seeming barrier for previous secondary SC 485 visa holders to apply for another SC 485 as the primary applicant is causing significant distress to affected applicants. It is not yet clear if this change has been as a result of a drafting error or is deliberate. We will inform once further clarification is received. 11.01.2022 PTE Concordance Report ===================== Pearson PTE has recently released a report that has reassessed the concordance between PTE English language scores and those of the IELTS scores.... PTE has adjusted some scores to better align with the IELTS standard scores. These changes have been reported to the Government's of Australia, New Zealand and the United Kingdom, all of who accept PTE English language tests for migration purposes. However, until a new legislative instrument is released changing the scores, the currently legislated scores will remain in force. Nevertheless, the one must not expect retrospective changes to the scores for applications lodged before any changes are implemented. 09.01.2022 Further inbound travel exemptions announced ================================= The Department's COVID site has been updated to allow additional categories of persons to be automatically exempt from travel restrictions and can enter Australia, without obtaining an individual exemption. Exempt categories:... You are automatically exempt from the travel restrictions and can enter Australia (without obtaining an individual exemption) if you are: => an Australian citizen => a permanent resident of Australia => an immediate family member of an Australian citizen or permanent resident* => a New Zealand citizen usually resident in Australia and their immediate family members => a diplomat accredited to Australia (holding a subclass 995 visa) => a traveller transiting Australia for 72 hours or less => airline crew => maritime crew including marine pilots => recruited under the Government approved Seasonal Worker Program or Pacific Labour Scheme => holder of a Business Innovation and Investment (subclass 188) visa * If you hold a temporary visa or do not yet hold a valid visa for Australia, you must provide proof of your relationship (such as your marriage certificate, evidence of your de-facto relationship such as shared finances or property, your birth certificate or birth certificate for your children) to the Department before you travel to Australia. Do not travel until we advise that you can. You can find out more about how to provide this information here. You need to carry evidence that you meet one of the above categories when travelling. VAC waivers will be available for the following visa subclasses:- => Visitors visa holders - overseas and with visas that expired or will expire between March 2020 and December 2021 will be eligible for VAC waiver for a new visa. => Working holiday maker visa holders - unable to enter Australia or who left Australia early due to COVID-19 - eligible for a VAC waiver for a new visa. => Temporary skilled visa holders - who have been unable to make initial entry to Australia, or who returned home due to COVID-19 - eligible for VAC waiver for subsequent applications. VAC refunds will be available for the following visa subclasses:- => Prospective Marriage visa holders - visa holders unable to enter Australia before their visa expired due to COVID-19 related travel restrictions - eligible for refund of VAC. => Seasonal and Pacific Island workers - who applied for visas before 20 March 2020 and were unable to enter Australia - eligible for refund of VAC. 08.01.2022 Correction to LMT-job advertising required for 482 and 494 visa Visa applications ============================================= LMT Advertising - Compilation Instrument LIN 18/036 confirmed as incorrect:- Migration (LIN 18/036: Period, manner and evidence of labour market testing) Instrument 2018 contained what appeared to be an error in the number of LMT advertisements required.... Following contact from the MIA on 30 September 2020 when the Instrument was first released and again, 6 October 2020, the Department has now informed the MIA that the drafting of the Compilation Instrument is indeed incorrect. The Department has confirmed that the Instrument does not accurately reflect the latest change to labour market testing requirements. The critical words: in at least two advertisements were omitted, in a transcribing error. It is therefore confirmed that nominations for Subclasses 482 and 494 lodged from 1 October 2020, must have been must be advertised on the Jobactive website in addition to 2 other advertisements with national reach in Australia. The Department is working with the Office of Parliamentary Counsel to upload the correct compilation document within the next few days. 04.01.2022 New Priority Migration Skilled Occupation List announced ========================================== Immigration Minister Alan Tudge has announced a new Priority Migration Skilled Occupation List (PMSOL) of 17 occupations that will be able to enter Australia to assist in the country's COVID recovery. Visa holders, who have been sponsored by an Australia business in a PMSOL occupation can request an exemption from Australia’s travel restrictions, but will be subject to a strict... 14 days quarantine on arrival at their own expense. Existing skilled migration occupation lists will remain active and visas will still be processed, but priority will be given to those in occupations on the PMSOL.
