18.01.2022 Battle of the 'Day' The meaning of 'day’ is self explanatory. However, a recent decision in the Full Federal Court considered the definition of 'day' in the context of the Fair Work Act 2009 (Cth). ... The general industry practice is to interpret a ‘day’ as a notional day which is based on one’s ordinary working hours per week. For example: Full time employees work 38 hours per week Across a five day working week, that’s 7.6 hours per day Accordingly, employees get 76 hours (ten notional days) of personal or carer’s leave per year. Surprisingly, the Full Federal Court by majority found that a 'day' means one full day, meaning that if an employee works 12 hour days, then that employee will be entitled to 120 hours per year. The ruling has significant implications on Employees’ rights and entitlements. This decision has raised the eyebrows of Employers and the Government, and an appeal to the High Court of Australia is on the table. Stay tuned! 17.01.2022 We trusted that they would do the right thing A parliamentary inquiry into the NSW Public Trustee and Guardian (NSWTG) has begun after allegations that the financial management service changed wills despite the lack of consent of clients and family members. The legal proceedings that launched the investigation began after an elderly woman was charged with a considerable amount of costs for the management service, despite concerns about her ability to understand them. ... The fees associated with the service of NSWTG accumulated to an amount of $24,000, even though it wouldve cost $5,636 for the same services in the private sector. There are also allegations that NSWTG had removed her son as the executor of her will without his knowledge. This is not the first time that NSWTG has failed to act in good faith, with reports of the state body being unable to make decisions for people with disabilities who need assistance. As a result, there has been a call for NSWTG to meet community standards with transparency and honesty. 16.01.2022 Yesterday, Circle Bridge Legal represented an Uncle and a Grandfather seeking parenting orders in relation to a Child in the Family Court of Australia. This matter has a long and tragic history where the Father of the Child was killed when the Child was only 1 years old. The Uncle took on the role of a fatherly figure, however, after the Uncle started to forge strong bonds with the child, the Mother closed off the entire Paternal family from the Childs life and refused to a...llow the Uncle and the Grandfather any contact with the Child. Meticulous and careful preparation was required by filing detailed Affidavits and the issuing of numerous Subpoenas to the Childs daycare centres and Psychologist. Following lengthy submissions, the Family Court of Australia found that it was in the best interests of the Child to spend time with the Uncle and Grandfather. 14.01.2022 Moving into the Future! Electronic conveyancing is the digital completion of conveyancing transactions including the transferring of property ownership from the Seller to the Buyer. As of 1 July 2019, all mainstream property transactions must be now conducted electronically. This change has been in transition for a number of years from the paper settlement process to electronic settlements, however has now become mandatory.... Paper Certificates of Title will also be completely replaced by electronic Certificates of Title, known as an eCT. 13.01.2022 Recently, the High Court of Australia handed down a landmark decision which held that a sperm donor who took an active parental role, is the Childs legal father. In this case, the High Court stopped the Mother and her partner from moving to New Zealand with the Child as they had not consulted the legal Father. The Court stated "Being a biological parent is not the whole answer to the question 'who is a parent?'". This may also apply to cases where a family member (e.g Uncle..., Aunty or Grandparent) has a close relationship with a Child and also took an active parental role. 12.01.2022 Helping first home buyers buy a first home The Federal Government has proposed a scheme which will allow first home buyers on middle and low incomes to enter the property market with deposits as little as 5%. The scheme will offer loan guarantees for Capital City and Regional Centre properties capped at $700,000. Properties outside of the Capital City and the surrounding regions will be capped at $450,000. Although no specific number of guarantees per jurisdiction has been... provided, depending on the demand, it is estimated that up to 10,000 guarantees will be granted per year. This benefit will specifically be granted to couples earning less than $200,000 per year and singles with a taxable income of up to $125,000. However, only 2 of the big four banks will be partaking in the scheme as well as 50% of all guarantees being granted to smaller banks and lenders. The proposed scheme is expected to take effect within the next couple of months. 09.01.2022 There are two ways of buying property with another person in Australia, that being either a Joint Tenancy or Tenants in Common. In simple terms, a Joint Tenancy means that each owner has an equal ownership and interest in the property and that there is a right of survivorship. The right of survivorship means that if one of the owners pass away, the property will automatically transfer to the surviving owner. ... On the other hand, a Tenants in Common structure refers to the method of co-owning property with defined shares. For example, a co-owner can sell their shares to another individual. There is no right of survivorship and in the event a co-owner passes away, that share will be transferred in accordance with their Will. 08.01.2022 Last week, we appeared in the Federal Circuit Court of Australia for a Father that had concerns for the safety of the Child in the presence of the Mother. The Father left the matrimonial home with the Child and requested that she seek urgent help. The Mother had admitted to having psychological concerns such as suicidal thoughts and self-harm. The Mother made an application for the Child to be returned to her care raising issues of domestic violence and controlling behavio...ur by the Father. We served subpoenas on NSW Police, her medical practitioners, the Hospital and other parties concerning the Mothers mental health. Our investigations confirmed that the Mother had maliciously approached NSW Police on a number of occasions requesting they return the Child to her care. This evidence was utilised to show that the Mother was willing to lie and do anything for the Child to be returned to her care, hence her evidence should be given little weight. The Court made orders in the Fathers favour that the Child remain in his care until the Mother satisfies the Court of her mental health with a Report from her treating Psychologist. 07.01.2022 - The Construction Crisis - The Mascot Towers is the second instance where an emergency evacuation has occurred in Sydney high-rise apartments . With over 114,000 apartments being built in Sydney within the past 5 years, there are grave concerns for the integrity of construction and the rise in building defects. During construction, there have been reports of compliance failures by builders, lack of competence of operators, poor understanding of construction codes or poor do...cumentation. In addition, the shift of compliance checks from Local Government to Private Certifiers has become an increasing issue as Certifiers are not on construction sites frequently enough to detect problems before they are concealed. 02.01.2022 Circle Bridge Legal had a successful week with two Family Law matters being settled, without the need to proceed to Hearing. One was a Financial matter and the other was a Parenting matter. Our Family Law Team appeared in Sydney during the week where the Wife sought a 70% split of the matrimonial home in her favour. Following detailed instructions, we considered this to be excessive and advised the client to insist on an equal split of the matrimonial home.... On the morning of the Hearing, the matter was successfully negotiated for the sale of the matrimonial home, with the net proceeds to be split equally and not as proposed by the Wife. The Parenting matter was also contested and listed for Interim Hearing. Our Team was successful in negotiating Orders so that the Father could spend time with his 18 month old son.
