23.01.2022 I have been asked by clients on numerous occasions what does Probate mean. Before an executor applies for probate, they will have to carry out some basic investigation work such as locating the deceased's assets and liabilities, assessing the value of their assets, and finding out what asset-holding institutions require before they will release funds. Probate is an order from the Supreme Court stating that the will has been proved to be the last valid will of the deceased a...nd allowing an executor to collect and distribute the estate in accordance with the terms of the will. Probate will always be necessary if the deceased died owning real estate except if it is owned as joint tenants. Generally, when an estate is very small and uncomplicated, or when all assets are held as joint tenancies, there is no need to obtain probate or letters of administration. The need for a grant of probate also depends on the form in which the assets are held. Some asset holders will require you to produce a grant of probate before they will release assets above a certain value.

13.01.2022 What is a Power of Attorney? A Power of Attorney is a legal document made by you that gives another person, known as your attorney, the authority to manage your assets and financial affairs in the event that you are unable to do so when the need arises (e.g. due to illness, as a result of an accident, or simply as a result of your absence). For example, your attorney may buy and sell real estate, shares and assets on your behalf, operate your bank accounts, and pay your bil...ls. Making a Power of Attorney does not mean that you will lose control of your financial affairs. It simply gives your attorney formal authority to manage your financial affairs according to your instructions. Your Power of Attorney can be revoked at any time, provided you have the capacity to do so. What is an Enduring Guardianship? A Power of Attorney only grants authority to your attorney to handle property and financial matters. It does not give someone the right to make decisions about your lifestyle, medical treatment or welfare. Lifestyle decisions are covered by Enduring Guardianship which allows you to legally appoint a decision-maker of your choice to make those lifestyle and health care decisions should you lose the capacity to make your own decisions. The appointment of your Enduring Guardian only takes effect if you lose the capacity to make your own personal or lifestyle decisions. It is limited in its powers and does not also give authority to someone to handle your financial affairs this is covered by a Power of Attorney. 12.01.2022 Basic common mistakes of Will kits and online wills Some of the most common mistakes that I see as I fix or rewrite Wills that were unsatisfactorily created from a Will kit include: Assuming that the will maker will die before their spouse and thus not leaving any directions for their assets in case their spouse dies first;... Not disposing of all of their assets; Appointing just one executor (usually a spouse), without providing an alternate in case the executor dies before the will maker; Appointing an executor with a conflict of interest (like business partners, or family members caught up in some form of family disharmony); and Not having the Will correctly witnessed.
