23.01.2022 The second series in the Toowoomba Urban Design Forums was held last night. The theme was transport planning and I was not impressed with the speakers at all. With a beautiful town like Toowoomba, one hopes that the same old mistakes will not be repeated. Yet the speakers had little to say of any vision or substance.The university professor admitted that his research into people's emotional responses to physical space had no direct relevance or applicability to urban design. The AECOM consultant didn't like the range road because of the big trucks and because there wasn't a sign saying City Centre. (I don't know about you, but I usually look up a map on Google when I am going to a new place!) Can't remember anything interesting that the third fellow employed by Council had to say. OMG!!

18.01.2022 Ecological Assessment Seminar- EPBC Act does not recognize past State Planning Approvals and new listings of endangered species may still apply to projects currently under construction. There are steep penalties for non-compliance. It is up to the applicant to refer a project if it affects a Matter of National Environmental Significance (MNES). This can even apply to small projects such as a House if it results in clearing of endangered vegetation or endangered habitat for en...dangered animals. Koalas were listed as an endangered species in 2012. The new Vegetation Offset legislation applies to Brisbane, Logan, Frazer Coast, Redlands, Ipswich and Sunshine Coast regions.Whether the offsets approach will preserve the koalas or only the vegetation is a matter for further research. There is also differences between the State Government's minimum threshold (5ha) and the Commonwealth (20ha). Local Government offsets policies can be the cheapest option whereas the SG offsets costs can be prohibitive. It seems that much of the emphasis is still on impact assessment of particular projects rather than strategic planning supported by detailed ecological studies.

18.01.2022 29 July 2020 DAF has introduced changes to the Agricultural land classification Class A and B Data improvements - new data collected, new projects released or older data has been reviewed or updated to ensure greater consistency with the definitions of class A and B land, as defined in the Queensland Agricultural Land Evaluation Guidelines Additional attributes added to the data - allowing users to identify scale and original land resource survey information. Improved metadata - including detail on limitations and refinements to ensure that users are more informed about how the layer is created and limitations of use. Further refinements to the urban masking process to remove slivers in urbanised areas.

However the $$$ involved in offsets calculations for South East Queensland are scary,especially for smaller developers. HOw effective is it going to be? Well as usual with most planning legislation in queensland they spend a lot of dollars reviewing legislation but never monitor whether it performs any better!!

09.01.2022 The Planning and Development Bill went up to Parliament for its first reading on 25 November 2014. The Planning and Development Act (PAnDA) seeks to streamline the plan making and development assessment processes and thus contribute to the economic development of the State. The new Act is expected to be assented to by mid 2015.

08.01.2022 In conjunction with the community, Lockyer Valley Regional Council has developed a Natural Resource Management (NRM) Strategy which was adopted by Council at its meeting on 22 January 2020. This NRM Strategy is a high level, overarching document which provides the communitys strategic direction for our natural asset management over the next 10 years. The Lockyer Valley - Natural Resource Management Strategy 2020-2030 can be downloaded and viewed via the Engagement Hub.... 07.01.2022 Lake Clarendon State School ANZAC Day service. Lovely grounds and a wonderful group of students and staff. A very moving service ending with poppies laid under the "Lone Pine" tree planted in the school grounds.

06.01.2022 The State Infrastructure Plan is being developed by DSDIP in association with the Australian Govt in their audit of northern Australia to align infrastructure priorities for this region. This included the need for dams and water storage facilities. It is expected to be released in late 2014. Certainty of water supply is vital to both the agriculture strategy and the development industry. However environmental impacts also need to be carefully considered.

05.01.2022 Koala mapping introduced 7 February 2020 New koala habitat mapping for South East Queensland The Queensland Government has released new koala habitat mapping for South East Queensland to support implementation of the South East Queensland Koala Conservation Strategy, and amended koala conservation protections within the planning framework. This mapping replaces previous koala assessable development area mapping.

04.01.2022 Titling Seminar by Greg Short of Bennett and Bennett. This video link up was hosted by Toowoomba Regional Council. Thanks again to TRC and PIA for arranging this instead of having to travel to Brisbane. There were 5 other regional centres throughout Queensland also linked in. The most interesting update was regarding the use of High Density Easements over small lots. This amendment to the Land Titles Act in 2013 is starting to ripple through the system. It allows for mainte...nance work and stormwater collection to occur over a single freehold lot. Previously this could only be effected by a Community Titles Scheme with a Body Corporate setup to administer the common property. Not that these easements will not appear on the Survey Plan. They are documented on the Property Title and take the form of a standard easement document. Another interesting point to note. Whilst for most structural elements, it is the CENTER of the common walls and ceiling/floors that are used as the boundaries between lots on a Building Format Plan, it is the OUTSIDE face of a balustrade that is taken to be surveyed boundary.

03.01.2022 The Planning and Development Act 2014 (PDA) is on its way. The draft Bill is open for comment until 26th September 2014. The new Act is unlikely to be given effect before March 2015. Much of the process of planning has been removed from the Act and put into the Regulations thereby making it simpler for amendments to be made and schemes updated. Standard planning scheme provisions (QPP) have been removed.... There are new categories of development: - Accepted (previously self-assessable); - Assessable - Standard (previously code) - Merit (a hybrid of code and impact- no public notification - Merit Notifiable (previously impact) - Prohibited Other changes: - Decision rules are not in the Act. - Public notification requirements. - Ability to elect not to receive an information request. - Applicant driven process not assessment manager led. - Changes to owners consent requirements. - Changes to amending approvals. - Dispute Resolution will be controlled by a new act The new Planning and Environment Court Act 2014 will increase the power of the ADR Registrar to hear and determine matters and there is a greater emphasis on ADR and alternate avenues for appeals and disputes resolution. Tim Nicholls of the Liberal National Party (LNP) (Shadow Minister for Infrastructure, Planning, Small Business, Employment and Trade) introduced three private members Bills to the Queensland Parliament: Planning and Development (Planning for Prosperity) Bill; Planning and Development (Planning Court) Bill; and Planning and Development (Planning for Prosperity- Consequential Amendments) and Other Legislation Amendment Bill 2015.

02.01.2022 MEDIA RELEASE FROM the PLANNING INSTITUTE OF AUSTRALIA PIA calls for removal of urban design trigger The Planning Institute of Australian (PIA) has welcomed aspects of the Queensland Governments proposed planning reforms, but has voiced serious concerns about the introduction of a state-wide urban design trigger.... The urban design trigger would give the government the power to call in any project it deems to be of state significance for an urban design review, potentially adding months to its program. PIA Queensland President, Todd Rohl said the new trigger was unnecessary and unhelpful overreach by the Queensland Government. The urban design trigger ignores the significant professional capabilities of planners, architects and urban designers, Mr Rohl said. It is nothing more than government overreach. The last thing Queenslands property sector needs is unwarranted and unnecessary red tape that has the potential to stifle investment and design innovation. See more

02.01.2022 The Queensland State Government has introduced new plumbing and drainage legislation as a result of the new Act ALL plumbing permit applications submitted from 1 July 2019 must be accompanied by the new Form 1 Permit work application for plumbing, drainage and on-site sewerage work. Plumbing is regulated by Council under the current State Government legislation, available for viewing on the Department of Housing and Public Works website.

02.01.2022 Toowoomba Regional Council has proposed a minor amendment No 6 which wholly deletes and replaces each part (including schedules and appendices) of the Toowoomba Regional Planning Scheme 2012 (TRPS) to ensure it is consistent with the latest version of the Queensland Planning Provisions (QPP). Pity the draft Planning and Development Bill (see below) proposes to remove the QPP from the new legislation. (Not to mention the $$$ that were spent on all that work revising their fairly new Planning Scheme).
