23.01.2022 During the Covid-19 shut down Tom was admitted to the New South Wales Supreme Court and has officially started his legal career as a practicing Solicitor. Tom studied at University of Canberra undertaking a double degree in Commerce/Laws. While studying Tom took part in two student exchange programs the first to Rome and the second to Stockholm. Prior to joining Clark McNamara, Tom spent three years in Sydney working in consulting. In 2019 while completing his Graduate Dip...loma in Legal Practice Tom joined Clark McNamara. 20.01.2022 What happens if you are caught drink driving? 1. The police can give you an on the spot fine and suspend your licence immediately if: a. it is your first drink driving offence; and... b. your blood alcohol reading was in the low, novice or special range. If you admit the offence, you should pay the fine or make arrangements to deal with the fine before the due date. If you have received a fine and an immediate suspension of your licence, you must not drive during the period of the suspension. 2. If you are charged with a more serious drink driving offence then you may be issued with a Court Attendance Notice (CAN) from either the Roads and Maritime Service, your local council or the police. You should also receive your Certificate of Blood Alcohol Concentration relating to your charge. The CAN will tell you: a. The date and time you are required to attend court; b. Which court you will need to attend; and c. What you have been charged with. 13.01.2022 Going to Court for a PCA driving offence As we all slowly start to get out and about again after the state lock down laws start to ease it is timely for everyone to have a refresher on what could happen if you dont have a Plan B. Drink driving is a factor in about one in every seven crashes in NSW where someone is killed. Drink driving is a serious offence. It is also an offence if you refuse to take a breath test. Penalties and other consequences vary according to the off...ence. If you are caught drink driving, the penalties you can get for breaking the law also depend on how much over the limit you are, so you can be charged with low, middle, high, special and novice-range PCA offences. For first time offenders with a blood alcohol reading in the lower ranges, instead of having to go to court, you might receive a penalty notice (fine) and an immediate suspension of your driver licence. So what are the different ranges of Prescribed Concentration of alcohol offences (PCA): The charge of driving a vehicle with a blood alcohol concentration of between: a. Low range .050 and .079; b. Mid range .08 and .149; c. High range at least .150; d. Novice range .001 and .019 (Learner, P1 or P2 driver); e. Special range.020 and .049 (Learner, P1 or P2 driver or a bus or taxi driver) Each range has a different maximum penalty and maximum and minimum licence suspension periods. The Road Transport Act also contains offences relating to driving under the influence of alcohol or a drug (Section 112) and driving with an illicit drug present in their system (Section 111). 12.01.2022 From 16 March 2020, by Order under the Public Health (COVID-19) Public Events) Order 2020, it has been directed that a person must not hold a public event at which there are, or are likely to be, 500 persons or more in attendance at any one time. This includes events even if entry to the event requires the purchase of a ticket or the payment of an entry fee. This order does not effect, going to court, educational services or public transport services. 12.01.2022 COVID-19 Restrictions are easing but fines and penalties are NOT!! So, what are the consequences if we break the rules? For example, you find yourself with more than 5 visitors in your household or at a public gathering of more than 10 people and come to the attention of the NSW Police? ... In such a circumstance you are in breach of a public health order and penalties are enforceable under Section 10 of the Public Health Act 2010, this is also a criminal offence. You as an individual face a maximum penalty of up to $11,000.00 or imprisonment for 6 months or both. Keeping in mind the NSW Police may also issue an on the spot fine of $1,000.00 to each person present. Cowra Council will be receiving an additional $1 million from the Federal Government designed to provide immediate economic stimulus to drought-affected communities to invest in local community projects.... Council's services and facilities. The 2020 Community Survey will assist Council in identifying priority areas and needs for the future of the Cowra Shire. Residents over 18 years of age may be selected at random to participate in a telephone survey this week conducted by IRIS Research. Groups applying must be not-for-profit, primarily volunteer run and based in Cowra Shire. Projects must also directly benefit the local community. 08.01.2022 NSW: extension of support for commercial tenants and landlords impacted by COVID-19. The NSW Government has announced a six-month extension of the measures put in place to help tenants and landlords financially disadvantaged by COVID-19. The Retail and Other Commercial Leases (COVID-19) Regulation was set to expire on 25 October 2020 but will now be extended to 31 December 2020. Tenants will be required to re-establish their eligibility under the extension to the Regulation... if they wish to request further rent relief, while landlords will also be required to respond to a tenant’s request for further rent relief in a reasonable time frame. Today is World Suicide Prevention Day. 2020 has been a challenging year for everyone and circumstances have made it even more important for us all to stay connected and, for those who are able, be willing to support those around us.... Eight Australians die every day by suicide. Thats more than double the road toll. People in rural populations are 2 times more likely to die by suicide. For each life lost to suicide, the impacts are felt by up to 135 people, including family members, work colleagues, friends, first responders at the time of death. You dont have to be an expert to keep the conversation going when someone says theyre not OK. By knowing what to say you can help someone feel supported and access appropriate help long before theyre in crisis, which can make a really positive difference to their life. This order is to deal with public health risk of intentionally spitting or coughing on public officials or other workers in a way that is reasonably likely to cause fear about the spread of COVID-19.... Have the need to cough remember to cover your mouth - the maximum penalty for breaching a health direction - 6 months imprisonment or a fine of up to $11,000.00 or both!!!!!

07.01.2022 Today is World Elder Abuse Awareness Day Elder abuse includes physical, emotional, or sexual harm inflicted upon an older adult, their financial exploitation, or neglect of their welfare by people who are directly responsible for their care. As older adults become more physically frail, theyre less able to take care of themselves, stand up to bullying, or fight back if attacked. Mental or physical ailments can make them more trying companions for those who live with them. A...nd they may not see or hear as well or think as clearly as they used to, leaving openings for unscrupulous people to take advantage of them. Elder abuse tends to take place where the senior lives: where their abusers are often adult children, other family members such as grandchildren, or a spouse or partner. Elder abuse can also occur in institutional settings, especially long-term care facilities. If you suspect that an elderly person is at risk from a neglectful or overwhelmed caregiver, or being preyed upon financially, its important to speak up. Everyone deserves to live in safety, with dignity and respect. The NSW Elder Abuse Helpline is available Monday to Friday, 8.30 am to 5 pm. Call 1800 628 221. Anyone can make the call. While elder abuse is a complex problem with no one simple solution, we at Clark McNamara can assist you in understanding your rights or the rights of someone you love. 04.01.2022 Drink driving offence - what happens when I go to court? When going to Court you will need to decide on your plea: a. Guilty; or b. Not guilty.... c. When deciding which plea to enter it is important to consider all the facts and elements of your charge and whether this is your second or subsequent offence. It can be a good idea to get some references from people who can vouch for your good character. These references should be addressed to the Magistrate and should not be general references they should refer to the current drink driving charges before the Court. If you choose to represent yourself in Court, you will be required to speak to the Magistrate. The Court will consider a number of matters when deciding what penalty is appropriate for the Drink Driving Offence: Whether you believed you were over the limit when you drove; Whether you were detected by random breath test or as a result of erratic or dangerous driving; If any collisions occurred; The number of people put at risk by the driving (passengers, pedestrians, etc.); The effect that a licence disqualification may have on your livelihood (employment or other people who rely on you such as your children); What your overall traffic record is like; The likelihood of you reoffending. It is up to the Court to decide which penalty should apply. As a general guideline, a major factor will be how far over the legal driving limit you were. All offences are subject to automatic disqualification of your license. First-time offence penalties range from a $1,100 fine up to a $3,300 fine and possible jail time depending on how far over the legal driving limit you were. With all drink driving matters there are a variety of strategies that can be put into place immediately to reduce the likely penalty you will face and while there is a lot of information on the internet advocating self-representation in drink driving offences. The reality is that a case properly prepared and presented by an experienced lawyer will usually result in a better outcome. This may mean you get your licence back months earlier or pay a substantially less fine than you otherwise would have. Additionally, unless you are on bail, a lawyer can go to the first mention dates without you needing to be there, saving further time off work.
