23.01.2022 For those employers who pay leave loading to staff you should take a look at the new ATO ruling which now regards the payment of leave loading as part of ordinary time earnings which attract superannuation. In the past the payment of LL has often been seen as a separate amount but the ATO definition changes this. 21.01.2022 Hmmm....you know the trouble with emails is we tend to say things in an email, that we would never say to a person’s face. They are often misinterpreted because we all put a ‘voice’ in them that they not be intended. That ‘voice’ will be influenced by how we feel about the person who sent the email and/or by the timbre of our most recent communication with them. If I speak to you personally then I am using every part of my tool kit, facial expression, tone, body language etc... to get my message across. What have I got in an email? Just words alone, and how many of us are really good at communicating in the written word anyway? But are emails totally bad? As a form of communication, they are intrinsically dangerous and unreliable BUT as tools for the confirmation of fact they are incredibly useful. So, what am I saying here? Try to make it a golden rule that when you want to actually communicate with an employee or colleague speak to them first! Ideally on a one to one but as a second best by telephone THEN once you have established the purpose of your communication and fostered understanding email a summary of the discussion to reinforce the key points. Simples!!!

18.01.2022 Amongst my services I also do content writing for Award submissions, website content, preferred supplier status submissions and all kinds of other professional writing. 15.01.2022 Casual Employment? Whether you are State based or Federal the definition of casual employment is the same ie ‘irregular and unpredictable employment’. So logically, if the employment you are offering is reasonably regular and reasonably predictable it is more likely to be considered to be at least part time should you end up in a dispute or be audited. Also, in the Federal system ALL Modern Awards now contain provisions that confer the right for any casual employee to apply f...or re classification to part time or fulltime dependent on their past hours and future expected hours. Whilst the State Awards don’t necessarily have this specific wording there is no ‘get out of jail free card’ either. Many State employers have been successfully challenged by disgruntled employees who make a claim that they are in fact part time or fulltime employees with heavy penalties and repayments ensuing. If you have ‘casual’ employees who regularly work in excess of 12 hours per week then you have a potential issue, and while we are on that subject there is NO SUCH THING as a ‘permanent casual’ in either the State or Federal system.



14.01.2022 Just completed the fourth of seven PD sessions focussing on Managing Confrontation and Dealing with Difficult People. The session was great and provided some insights into how to manage ourselves and deal with emotions during these kinds of meeting.

14.01.2022 It may come as an unpleasant surprise to many SME's that their fulltime and part time employees absent from the workplace on bonafide workers compensation will accrue annual leave entitlements throughout this period. This applies whether they are working on a return to work program or not. Whilst the WA Act makes it clear that sick (personal ) leave does not accrue the FWO has ruled that AL does. Make sure that you understand your rights and obligations in this very tricky area.

14.01.2022 Well, it has been an incredibly busy and rewarding 12 months building up a great group of clients who in turn have made many referrals. Thank you to everyone who has liked the CWS page or accessed my services. 12.01.2022 Having been engaged by Community Home Care to write their award submission I am delighted that they were announced winners last Friday the 12th July of the ACSA Award for the best 'Regional, Rural and Remote Provider' of the year. This was well deserved and a tribute to all of their Management team, staff and volunteers. Well done!! Now it's on to the Nationals!!

10.01.2022 Like me, many of you may have downloaded and regularly refer to the FWO’s Pay Scales for specific pay rates for your staff. Please remember that these are regularly updated by the FWO and I would strongly advise you to delete your current copy(ies) and download a fresh version every 3 months. There have been a number of changes to penalty rates and allowances in recent months across a number of Awards. You can subscribe to the FWO’s update service to keep abreast of changes.

06.01.2022 A great presentation for a couple of my Bunbury and Collie clients presented by the fantastic Lisa Kniebe as a first of seven sessions series of professional development workshops I am presenting. Amongst many other talents Lisa is an accredited Click Colours! presenter there was some great interaction amongst participants and a fair bit of insight into ourselves as people and our relationships with others, not just in the workplace. Thanks Lisa!!

05.01.2022 Here's an interesting one for you. Many employers don't realise that any time a permanent employee takes off work on paid leave such as personal leave, annual leave or paid public holidays actually counts as 'time worked'. Fix that clearly in your head because it also means that paid time off counts towards the accrual of and payment for overtime!! Don't believe me? Check with the FWO and then refer to the Fairwork Act itself.
