The Australian consumer watchdog , the #ACCC, regularly takes court action to protect our interests as consumers. In court proceedings commenced by the ACCC, last week the Federal Court of Australia determined that online travel industry giant, , had misled holidaymakers into believing that by booking hotels appearing at the top of Trivago search results they were getting the best price when, in fact, they were simply the prices generating the highest Trivago commissions. The groundbreaking Judgment could lead to the end of sponsored posts on comparator websites. Mitsubishi wanted to register a trade mark and use in Australia the word Absolute for their Triton Absolute. The car giants application was denied because a family owned business trading as Absolute Batteries h...ad already registered a trade mark for the word Absolute in 2014. After unsuccessfully offering to buy the trade mark from Absolute Batteries, for what is understood to be a trivial amount, Mitsubishi sought to legally challenge Absolute Batteries trade mark. If successful, this would have freed the word Absolute up for Mitsubishi to apply to trade mark. Mitsubishis legal challenge was an absolute failure, and the long-standing family business was protected by having registered its trade mark rights. 04.01.2022 A corporate and personal insolvency game changer is just one of the measures included in the Federal Governments second COVID-19 support package. Heres the snapshot, subject to enactment of legislation to give effect to the support package regulatory shield: Statutory demand threshold is increased from $2,000 to $20,000;... Bankruptcy notice threshold increased from $5,000 to $20,000; The maximum time for compliance with statutory demands and bankruptcy notices will be 6 months, not 21 days; and Insolvent trading liability on hold. 01.01.2022 From February 2020, tens of thousands of Australians will see their credit scores improve as a result of civil court filings no longer appearing on personal credit files. This boost in credit ratings will enable people to get credit or negotiate lower interest rates , where previously they may have been rejected. Court Judgments will continue to be recorded, but unless the Judgment relates to credit it will not impact on a persons credit rating....
