25.01.2022 SUCCESSION PLANNING GRANTS Are you a Farmer and thinking about planning for your retirement or the succession of your farm? Right now, the NSW Rural Assistance Authority (RAA) is providing funding for farming families to receive retirement, succession and estate planning advice. The key details of the funding program are as follows:... o Each eligible participant will be reimbursed for up to 50% of the GST exclusive cost of the advice; o The reimbursement is capped at $5,000 for the first applicant and $1,000 each for up to four additional applicants in respect of the one farming business (for example, four applicants consisting of father, mother, son & daughter-in-law could access up to $8,000 of funding); o Eligible participants include anyone involved in the management of a primary production enterprise who receives at least 51% of their income from primary production. We note that funding is currently available until 30 June 2020 or until funds are utilised. This is the most generous grant we have seen in our decades of providing legal advice to farming families. John and his wife ran the business until it closed in July,1954. Next door is Gurwood Chambers, built in 1912. The first floor was used by the NSW Pastures Protection Board. The ground floor by Fulham Gardens, prior to them moving across the road next to the Capitol Theatre. Younghusband Ltd bought the building in July,1950 and remodelled it for their offices. 21.01.2022 DRIVING WHILST USING YOUR MOBILE PHONE The NSW Government has announced an initiative that will use a world first Mobile Phone Detection Camera Technology targeting illegal mobile phone use anywhere, anytime. The new system will utilise High-Definition cameras to capture images of the front view and side angle view to detect both talking on your mobile phone and using your mobile phone illegally. Unlike speed cameras, there is no requirement to warn motorists of the cameras p...resence and the technology allows the cameras to be used both day and night and in all weather conditions. The current penalties available for driving whilst using your mobile phone is as follows: 1. 5 demerit points; 2. $344.00 fine. The penalties increase to a $457.00 fine if detected in a school zone and 10 demerit points during double demerit periods. Restricted licence holders including P1 and P2 are not permitted to use their mobile phone at all while driving or riding, which includes the use of hands-free devices. Further, if a learner or P1 motorist is caught using a mobile phone they will automatically face a three-month suspension of their licence. Further information can be found on the Transport NSW Road Safety website (search 'staying safe_mobile phones_know the rules'). If you have been issued an infringement notice for using your mobile phone whilst driving, the matter can be determined by the Local Court and a successful outcome may result in no fine and no demerit points being enforced. 18.01.2022 DIGITAL DRIVER LICENCE SCHEME ROLLED OUT ACROSS NSW The NSW Government has recently approved the NSW Digital Driver Licence which enables all NSW licence holders to download a digital copy of their licence to their mobile phone. The changes will allow the digital copy to be the accepted legal form of identification and will be accepted by most pubs, clubs and NSW Police. In NSW, a driver of a motor vehicle is not allowed to drive the vehicle without a drivers licence on him/h...er at the time. The offence carries a possible on the spot fine of $114.00 and if elected to be determined by a Court, the maximum penalty increases to a fine of $2,200.00. It is important that individuals are aware of the restrictions surrounding the Digital Drivers Licence such as cracked phone screens and what happens when your phone has a flat battery. 14.01.2022 SEEK YOUR OWN RECREATIONAL INSURANCE COVER The decision in Menz v Wagga Wagga Show Society confirms the Courts application of the provisions of the Civil Liability Act 2002 in relation to the conduct of recreational activities. https://www.dailyadvertiser.com.au//court-dismisses-47600/ ... The effect of this decision is that any person who might be injured in participating in a dangerous recreational activity has no entitlement to damages even if the injury is caused by the negligence of the organisation conducting the event, including a failure to follow its own rules. It has become clear that the interpretation of a dangerous recreational activity is being widely applied and could incorporate activities including common recreational activities such as bike riding, motorbike riding, horse riding, riding for the disabled, football, netball, water skiing and similar such activities. This decision sends a clear message to participants in recreational activities that they ought obtain their own personal injury insurance including income protection insurance. In effect, a participant in a recreational activity will have no entitlement to damages from the insurer of the organising committee in almost all circumstances. The effect of this position is that there is no incentive for organisers of recreational activities to be vigilant regarding the application of proper precautionary measures which one might expect during the conduct of such an activity. The legislative changes which have led to this position were as a consequence of significant agitation by insurance companies to the government. Such insurers are now in a position where they continue to collect premiums in respect of public liability insurance relating to the conduct of such events and have little or no liability for any claim that might arise. These recent decisions make it clear that the government ought urgently revisit this issue to protect community members who may be injured through no fault of their own whilst engaging in a recreational activity.

09.01.2022 Changes to Short Term Accommodation Rentals such as Airbnb As of 10 April 2020, changes have been made to the Fair Trading Act, the Strata Schemes Management Act and the Residential Tenancies Act to regulate the use of property for short term rental accommodation like Airbnb. The Fair Trading Act has been amended by the inclusion of Division 4A (ss54A-E) which permits a Code of Conduct for short-term rental accommodation arrangements.... Changes to Strata By-Laws to prevent short term accommodation rentals. The Strata Schemes Management Act 2015 now includes a new s 137A which permits an owners corporation to pass a by-law to prohibit a lot being used for short-term rental accommodation arrangement provided the lot is not the principal place of residence This means if someone lives in a strata property as their principal place of residence, they will still be able to rent out their home or rooms while they live there, or temporarily go on holidays. The Residential Tenancy Act has also been amended to exclude short term rentals of less than 3 months. Owners corporations need to consider whether they want to adopt a new by-law to limit short term accommodation. Any such by-law will need to be adopted by special resolution, with at least 75 per cent of votes supporting the proposal at a general meeting.
