These changes will affect applicants, card holders and organisations. *Important: If you have a paid blue card application in progress when the new laws start, you can continue working while your application is assessed.*... The changes include: the No Card, No Start lawyou cannot work or volunteer in a position requiring a blue card until your application is approved a new rule for expiring cardsif you dont renew by the expiry date, you will be subject to the No Card, No Start law and cannot work a requirement to notify us about changes in your police information as a card holder or applicant stricter requirements for people who rely on an exemption to work or volunteer with childrenthrough the introduction of the terms restricted person and restricted employment, and associated offences a new frequency testif you only work 7 or fewer days in a calendar year, a blue card may not be required. 12.01.2022 News Flash for Federal Members Only The High Court majority has rejected a Federal Court Decision that found employees working longer than standard hours are entitled to use those hours as the basis for calculating their entitlement to 10 days paid personal/carers leave for each year of service. Chief Justice Susan Kiefel and Justices Geoffrey Nettle and Michelle Gordon ruling overturns a full Federal Court majority finding last August that two 12-hour shift workers at a... Cadbury chocolate factory were entitled to 120 hours of paid personal/carers leave, rather than leave payments for 10 shifts of 7.6 hours. Federal IR Minister Christian Port and Employer Mondelez appealed against the Federal Court ruling. The High Court set aside the full Federal Court judgement and in its place declared that The expression 10 days in s96(1) of the Fair Work Act 2009 (Cth) means an amount of paid personal/carers leave accruing for every year of service equivalent to an employees ordinary hours of work in a week over a two-week (fortnightly) period, or 1/26 of the employees ordinary hours of work in a year. A day for the purposes of s96(1) refers to a notional day, consisting of one-tenth of the equivalent or an employees ordinary hours of work in a two-week (fortnightly) period. Putting children first was front of mind when the National Child Protection Week campaign was launched in 1990, with the aim of bringing abuse and neglect out of the shadows and putting child wellbeing on the national agenda. Since then, the need to put children first has been recognised time and time again as an important pillar for boosting the wellbeing of all children in Australia. Last years National Child Protection Week campaign was based on research that shows the importance of putting children first when talking about parenting, and continued the message that conversations are a key part of engaging the whole community in caring for children. Under this years theme of Putting children first we invite all Australians to look at how they can prioritise children in their lives and communities and to engage in National Child Protection Week as individuals, and as part of families, organisations, communities and society. Putting children first means prioritising the safety and wellbeing of children. To grow up well children need to feel safe and loved, have a chance to play and explore, have a say in decisions that affect them, and access to essential things like food, shelter and healthcare. For children to thrive we need to come together as a community and put childrens needs first during National Child Protection Week and every week. The Federal Government has announced a number of significant changes to the JobKeeper program which will commence from 28 September 2020 until the new end date of the program on 28 March 2021. These changes will have a significant impact on employees who are currently receiving JobKeeper as well as operations which have been receiving the subsidy. In short, the changes create a two tier system for employees. Employees w...ho worked less than 20 hours a week before the Pandemic, and the rest. The changes also introduce an obligation on an Employer to demonstrate that they continue to need the subsidy by showing a 30% loss compared to the same period in 2019. This is a major change as previously an organisation was only required to qualify once (in March 2020) and then they were covered for the duration of the program. 03.01.2022 Superannuation Guarantee Amnesty Employers participating in the amnesty need to apply by 7 September 2020! On 6 March 2020, the government introduced a super guarantee (SG) amnesty (the amnesty). The amnesty allows employers to disclose and pay previously unpaid super guarantee charge (SGC), including nominal interest, they owe their employees, for quarter(s) starting from 1 July 1992 to 31 March 2018.... Eligible disclosures will not incur the administration component ($20 per employee per quarter) or Part 7 penalty. In addition, payments of SGC made to the ATO after 24 May 2018 and before 11.59pm on 7 September 2020 will be tax deductible. Employers who have already disclosed unpaid SGC to the ATO between 24 May 2018 and 6 March 2020 dont need to apply or lodge again (see Disclosures of unpaid SG between 24 May 2018 and 6 March 2020).
