22.01.2022 While its probably OK to ask staff to wear your store-branded clothing and to set reasonable dress standards, you cant require them to purchase store-branded clothing (or any other store products). The Retail Award says that uniforms and other clothing like in-season floor stock staff are required to wear should be provided free of charge or that employees need to be reimbursed the cost. 12.01.2022 Minimum shift engagements are a thing. Do you know how many hours you need to roster employees for as a minimum each shift? Theres no standard rule it usually depends on your award or enterprise agreement. So, for example, under the Restaurant Award, casual employees need to be given at least 2 hours of work in a row (or paid for at least 2 hours, even if they were sent home earlier than that). While under the Hair and Beauty Award, each time a part-time or casual employee... works, they have to be given at least 3 hours of work in a row (or paid for 3 hours). 09.01.2022 Under the Fair Work Act, employers can ask for evidence when employees take paid sick leave, even if the employee was off work for a day or less. So what count...s as evidence? There are no strict rules, but it needs to convince a reasonable person that the employee was entitled to the leave. While an award or enterprise agreement can say what type of evidence employees have to give, the type of evidence requested must always be reasonable in the circumstances. So, for example, if employees are generally required to provide a medical certificate, but they couldnt get an appointment to see a doctor, they could provide a statutory declaration instead. And remember, while employers can request evidence, they are not required to. Employers can use their judgement, and may implement policies to say they only require evidence in particular circumstances, like on Mondays or Fridays, after public holidays or after a certain number of days off sick. A clear policy may help manage concerns about absenteeism while also making it easier for staff to take leave when they need it. 07.01.2022 All employees need to be given a pay slip for every pay day. Do you know what should be on them? Its not just the dollar amount theyre being paid. Some of the things that need to be included are: before and after tax pay amounts if being paid hourly, the ordinary hourly rate, the number of hours worked at that rate and the total dollar amount of pay at that rate... any loadings, allowances, bonuses, incentive-based payments, penalty rates or other paid entitlements any deductions superannuation contributions. 04.01.2022 It's best practice for employers to give employees warnings in writing before ending their employment. While an employer doesn't have to give an employee 3 warnings (or even 1 warning), they should give the employee a chance to fix any performance issues. If an employer fires an employee who then makes an unfair dismissal claim, the Fair Work Commission (a different agency to us) will usually take this into consideration. 02.01.2022 Theres no set rule about how much notice employees need to be given for roster changes it will depend on the rules in your award, enterprise agreement or emp...loyment contracts. So if youre making changes to rosters, make sure youre across the rules. Under the Restaurant and Hospitality awards full and part-time employees must be given at least 7 days notice of a change (unless the employee agrees otherwise). As a general rule, if you want to change an employees regular roster, you need to discuss it with them (and any representatives they have) first. Before any changes are made you should: give details about the change ask for their views about the impact of the change take their views into account when making a decision about the change.
