23.01.2022 PROPERTY WRITES: 'DOOM & GLOOM' FOR INVESTORS The Property Council of Australia (SA Branch) has declared current business confidence in the property sector to be at an all time low and even worse than in the aftermath of the 2016 Statewide blackout in SA. The PCA based its argument on its last quarterly survey measuring business confidence in every State. ... In a scathing press release issued today, the PCA persecuted the State government's plan to reform Land Tax touting it a 'bulldozer to business confidence' as portfolio property investors will be liable to pay more tax. Meanwhile, the State's welfare lobby group SACOSS today has praised the Government's Land Tax Bill on ABC Radio, saying it will free up the housing market for first home buyers who will no longer compete against cashed up investor-buyers. So, perhaps the Land Tax reforms provide a ray of hope for ordinary South Australians who may have been struggling to enter the market. Perhaps now they can look forward to a more level playing field. Isn't that ultimately good for our State? Indie.

02.01.2022 Property Writes: "THERE'S POWER IN PROPERTY." One of the highlights of studying a law degree was the English case of Entick v Carrington (1765). I distinctly remember how I felt suddenly empowered when our lecturer told us that property owners had more rights than the King of England even today some 250 years on! I am sure it was that moment that led me to practice conveyancing. And I do so today while tightly holding that golden nugget of truth.... So, what were the facts that led to this stunning judgement that was to shape our case law for the next 250 years? Entick (the plaintiff) wrote for the local newspaper and was thought to be critical of the Monarchy and was viewed by the King as a troublemaker. The King ordered a raid of Entick’s home for the search and seizure of his private documents. Entick subsequently sued the King’s chief messenger (Carrington) for Trespass and won! Lord Camden (pictured) said: By the laws of England, every invasion of private property, be it ever so minute, is a trespass. No man can set his foot upon my ground without my licence, but he is liable to an action, though the damage be nothing; which is proved by every declaration in trespass, where the defendant is called upon to answer for bruising the grass and even treading upon the soil. Of course, land it is not always unencumbered. Most of us have mortgages after all. But proprietors of land are absolutely protected from all ‘arbitrary’ attempts at taking away property rights, even if those attempts are made by Government. There is a sense of security and safety one gains from property ownership. That is the gift with which we are endowed by our laws. Property ownership is empowering.
