23.01.2022 Body Corporate Insurance the Who, What and Why explained! When a REIQ Contract is signed to purchase Residential Property (House, Unit or Land), the onus is on the buyer (yes, in the small print Clause 8.1) to take out adequate insurance after 5pm the next business day after the Contract date. CCQ has covered this in previous articles but we wanted to remind everyone working for a buyer of a Unit that this Clause still applies and to remind their clients of their obligat...ions to take insurance out in this time frame. When the risk is drawn to a Buyer’s attention (whether from the Agent or Conveyancer) most buyers ask why followed by doesn’t the Body Corporate take care of the insurance? To answer this the most efficient and direct way, simply say not always and ask them to insure the inside workings of the Unit everything from the front door to the back (cabinets, floor coverings, glass, public liability, water leaks, damage from kitchen fires contained within the unit etc) until such time as a full comprehensive search of the Body Corporate records has been done or you have identified what module the unit falls under and who is responsible to insure what. With Body Corporate modules currently under legislation review, it still does not negate the Conveyancers obligation to ensure the Buyer is fully aware that insurance implications can arise even within a Body Corporate complex. https://www.youtube.com/watch?v=Z3qcaJs94Ec
